Explanation
 
1. BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into two water tank painting projects with UCL, Inc.  The first contract is for the Henderson East 1 Million Gallon (1MG) & West 1 Million Gallon (1MG) Exterior Tank Painting Project, Division of Water Contract Number 2099, in the amount of $533,600.00.  The second contract is for the Walcutt (2MG) Interior Wet Tank Painting & Interior Dry Touch-Up Project, Division of Water Contract Number 3000, in the amount of $393,645.00.
Work on the Henderson East and West elevated storage tanks consists of cleaning and overcoating the existing exterior paint schemes.  Work on the Walcutt elevated storage tank consists of removing and replacing the interior wet coating system and spot repairing and painting the interior dry areas.
The geographic area of the Henderson tank is in the northwest part of Columbus.  The Walcutt tank is in the far west part of Columbus.  See attached maps for further detail.
 
2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  There are currently 37 water tanks in the distribution system maintained by the City of Columbus, Division of Water.  To keep these tanks in optimal condition, they need recoated and improved from time-to-time.  Both Henderson tanks need to be recoated at this time.  Additionally, there are significant paint failures on the interior of the Walcutt tank that need addressed as well as paint failures and spot repairs to the interior dry area.
3.1 CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened bids on January 21, 2015 from:
HENDERSON TANK:  UCL - $533,600.00; American Suncraft - *$889,065.00; D&M Painting - $451,950.00; Thomarios/Apostolos Grp. - $459,540.00; TMI Coatings - *$1,084,910.00; and Tecorp - $1,600,800.00.                   *after correction in bid tab
WALCUTT TANK:  UCL - $393,645.00; American Suncraft - $523,733.00; A - I Industrial Painting - $547,400.00; D&M Painting - $716,401.70; Tecorp - *$759,115.00; TMI Coatings - *$1,005,962.50; and Thomarios/Apostolos Grp. - *$1,066,050.00.                  *after correction in bid tab
3.2 PRE-QUALIFICATION STATUS:  UCL, Inc. has met code requirements with respect to pre-qualification, pursuant to relevant sections of Columbus City Code Chapter 329.  There are no proposed subcontractors on either project.
D & M Painting Corp., Thomarios/Apostolos Grp., A - I Industrial Painting, TMI Coatings, Inc., and Tecorp, Inc. did not meet the Responsibility Prequalification in Columbus City Code Chapter 329 and were, therefore, deemed non-responsive.
UCL's bid for both projects was deemed the lowest, most responsive and responsible.  Their Contract Compliance Number is 31-1697362 (expires 10/31/16, Majority).  Additional information regarding all bidders, description of work, contract time frame and detailed amounts can be found on the attached Information form.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against UCL, Inc.
4. FISCAL IMPACT:  A transfer of funds within the Water Build America Bonds Fund will be necessary as well as an amendment to the 2014 Capital Improvements Budget.

WHEREAS,  six bids for the Henderson East 1 Million Gallon (1MG) & West 1 Million Gallon (1MG) Exterior Tank Painting Project and seven bids for the Walcutt Two Million Gallon (2MG) Interior Wet Tank Painting & Interior Dry Touch-Up Project were received and publicly opened in the offices of the Director of Public Utilities on January 21, 2015; and
WHEREAS, the lowest, most responsive and responsible bids were from UCL, Inc. in the amount of $533,600.00 (Henderson) and $393,645.00 (Walcutt); and
WHEREAS, five bidders did not meet the Responsibility Prequalification in Columbus City Code Chapter 329, and were, therefore, deemed non-responsive; and
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute two construction contracts for the Henderson East and West Exterior Tank Painting Project and the Walcutt Interior Wet Tank Painting & Interior Dry Touch-Up Project with UCL, Inc.; and
 
WHEREAS, it is necessary for this Council to authorize a transfer and expenditure of funds within the Water Build America Bonds Fund, for the Division of Water; and
 
WHEREAS, it is necessary to authorize an amendment to the 2014 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditures; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Water, to authorize the Director of Public Utilities to enter into two construction contracts with UCL, Inc. for the Henderson East and West Exterior Tank Painting Project and the Walcutt Interior Wet Tank Painting & Interior Dry Touch-Up Project, for the preservation of the public health, peace, property and safety; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute two construction contracts for the Henderson East and West Exterior Tank Painting Project and the Walcutt Interior Wet Tank Painting & Interior Dry Touch-Up Project with the lowest, most responsive, and responsible bidder, UCL, Inc., 2025 Stapleton Court, Cincinnati, Ohio 45240; in the amount of $927,245.00; in accordance with the terms and conditions of the contracts on file in the Office of the Division of Water.
SECTION 2.  That the City Auditor is hereby authorized to transfer $927,245.00 within the Department of Public Utilities, Division of Water, Water Build America Bonds Fund, Fund No. 609, Dept/Div. No. 60-09, Object Level Three 6621, as follows:

SECTION 4.  That an expenditure up to $927,245.00 is hereby authorized for the Henderson East and West Exterior Tank Painting Project and the Walcutt Interior Wet Tank Painting & Interior Dry Touch-Up Project within the Water Build America Bonds Fund, Fund No. 609, Division 60-09, Object Level Three 6621, as follows:

SECTION 5.  That said construction company shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Water.
SECTION 6.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
 
SECTION 7.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
SECTION 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 10.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
