Explanation
 
The purpose of this legislation is to authorize the Director of Public Utilities to enter into a service agreement with Environmental Systems Corporation for software support and maintenance for the StackVision DASProtect Sentry for the Division of Sewerage and Drainage.
 
The DASProtect Sentry is a comprehensive support and maintenance plan for the StackVision and data controller products which are utilized to monitor and report stack emissions of the incinerator smoke stacks at the Jackson Pike and Southerly Wastewater Treatment Plants.  This monitoring and reporting of stack emissions helps the Treatment Plants meet its environmental compliance objectives to remain EPA compliant.
 
Environmental Systems Corporation is the developer of the software and provides all support and maintenance of the software.  This legislation is being submitted in accordance with the relevant provisions of Columbus City Code Chapter 329 relating to Sole Source procurement.  This agreement will be for the time period of March 1, 2015 through February 29, 2016.  This contract will not automatically renew.
 
SUPPLIER:  Environmental Systems Corporation (62-0807987), Expires July 7, 2016.
Environmental Systems Corporation does not hold MBE/FBE status.
 
The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
 
FISCAL IMPACT:  $27,554.00 is budgeted and needed for this software support and maintenance service agreement.  This ordinance is contingent on passage of the 2015 Operating Budget, ORD #2621-2014.

WHEREAS, the Jackson Pike and Southerly Wastewater Treatment Plants monitor and report stack emissions of the incinerator smoke stacks to help meet its environmental compliance objectives to remain EPA compliant, and
 
WHEREAS, the DASProtect Sentry is a comprehensive support and maintenance plan for the StackVision and data controller products, which are utilized to monitor and report stack emissions of the incinerator smoke stacks, at the Jackson Pike and Southerly Wastewater Treatment Plants, and
 
WHEREAS, it is now necessary to establish additional funding for the time period of March 1, 2015 through February 29, 2016, and
 
WHEREAS, Environmental Systems Corporation is the developer of the software and provides the support and maintenance of the software, and
 
WHEREAS, the Department of Public Utilities wishes to establish a service agreement in accordance with the relevant provisions of the Columbus City Code Chapter 329 relating to Sole Source procurement for said service, and
 
WHEREAS, it is necessary to authorize the Director of Public Utilities to enter into the service agreement with Environmental Systems Corporation for the purchase of the DASProtect Sentry software support and maintenance plan for the StackVision and data controller products utilized by the Division of Sewerage and Drainage, Jackson Pike and Southerly Wastewater Treatment Plants; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be and is hereby authorized to enter into a service agreement with Environmental Systems Corporation, 10801 N. Mopac Expressway, Building 1, Suite 200, Austin, Texas 78759, for the purchase of DASProtect Sentry Software Support and Maintenance for a period of one (1) year from March 1, 2015 through February 29, 2016, for the Division of Sewerage and Drainage, Jackson Pike and Southerly Wastewater Treatment Plants.
 
SECTION 2.  That the expenditure of $27,554.00 or so much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund 650, Department 60-05, to pay the cost of this contract as follows:

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
 
SECTION 4.  That this Council finds it to be in the best interest of the City of Columbus to enter into the service agreement in accordance with the relevant provisions of Columbus City Code Chapter 329 relating to Sole Source procurement.
 
SECTION 5.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
