Explanation
 
BACKGROUND: In September 2014, artist Terry Allen completed the first phase of his installation Scioto Lounge at Genoa Park. The installation consists of two bronze deer - one sitting, one reclining, and both looking out over the Scioto River. As part of Allen's contract, three additional, related art proposals were commissioned.
 
This legislation is submitted to complete the Scioto Lounge installation with a third deer, standing mid-point along the north rail of the Rich Street Bridge. All three deer will be viewable from the promenade along the east bank of the river.
 
The Department of Public Service has reviewed the proposal and has approved moving forward with the installation. On January 27, 2015, the Columbus Art Commission approved the design and placement of the art. Allen was one of three finalists in the 2012 North Bank Park Public Art Project, a curated invitational process.  
 
Terry Allen, a graduate of the Chouinard Art Institute in Los Angeles, CA, is an artist, musician and writer whose work has been shown nationally and internationally. Allen has received numerous awards and honors including a Guggenheim Fellowship and National Endowment for the Art Fellowships. Allen has had work at Documenta and at the San Paolo, Paris, Sydney and Whitney Biennales.  His work is represented in major public and private collections, including the Metropolitan Museum of Art, Museum of Modern Art in New York, and the Hirshhorn in Washington DC.  Allen was the first artist in residence at the Wexner Center for the Performing Arts at The Ohio State University.
 
FISCAL IMPACT: This legislation authorizes the appropriation of $154,200 from the Miranova TIF - City Riverfront Vision Account (Ordinance 1578-98), approved by Columbus City Council on June 29, 1998.

WHEREAS, the Columbus Art Commission (CAC) was seated in 2007 and Mayor Coleman signed an Executive Order to create a public art program in 2014; and
 
WHEREAS, in September 2014 the Scioto Lounge public art installation, consisting of two bronze deer, was installed at Genoa Park on the riverfront in downtown Columbus; and
 
WHEREAS, as part of the artist's contract, three original, similarly related public art proposals/study drawings were commissioned, one of which fulfilled the Commissioners desire for a third deer to complete the Scioto Lounge installation; and
 
WHEREAS, the third and final piece comprising the Scioto Lounge installation is a bronze deer standing mid-point along the north rail of the Rich Street Bridge;  and
 
WHEREAS, the Department of Public Service has reviewed the proposal and has approved moving forward with the installation; and
 
WHEREAS, on Tuesday, January 27, 2015, the Columbus Art Commission approved the design and placement of the third deer on the Rich Street Bridge; and
 
WHEREAS, the Department of Development desires to enter into contract with artist Terry Allen; NOW THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
SECTION 1.      That the Director of the Department of Development is hereby authorized to enter into a Design/Build Contract with Terry Allen (contract compliance #461644805, expires 5/24/2015) for a public art installation in the Scioto Mile/Rich Street Bridge for an amount not to exceed $154,200.00.
SECTION 2.      That from the unappropriated balance in the Miranova TIF Fund - City Riverfront Vision Account, Fund 406, and from any and all sources unallocated for any other purpose during the fiscal year ending in December 31, 2015, the sum of $154,200.00 is hereby appropriated to the Development Department, Department 44-01, Project 440071-100000, OCA 440071, Object Level One 03, Object Level Three 3336.
SECTION 3.      That for the purposes stated in Section 1, the expenditure of $154,200.00 or so much as may be necessary, is hereby authorized from the Development Department, Department 44-01, Miranova TIF - Riverfront Vision Account, Fund 406, Project 440071-100000, OCA 440071, Object Level  One 03, Object Level Three 3336.
SECTION 4.      That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5.      That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
