Title: To vacate the rights-of-way identified as an approximate 0.099 acre portion of the unnamed 30 foot wide east/west right-of-way east of Nelson Road between Franklin Park South and Bryden Road, and an approximate 0.269 acre portion of the unnamed 20 foot wide north/south right-of-way located east of Nelson Road between Franklin Park South and Bryden Road to facilitate improvements and enhancements to the city-owned property, known as Academy Park, located adjacent to both sides of these rights-of-ways.

 

 Explanation

 

1. Background:

The City of Columbus, Department of Public Service, received a request from The City of Columbus, Department of Recreation and Parks asking that the City vacate the rights-of-way identified as an approximate 0.099 acre portion of the unnamed 30 foot wide east/west right-of-way located east of Nelson Road between Franklin Park South and Bryden Road, and an approximate 0.269 acre portion of the unnamed 20 foot wide north/south right-of-way located east of Nelson Road between Franklin Park South and Bryden Road. Vacation of these rights-of-way will facilitate improvements and enhancements to city-owned property known as Academy Park. Per current practice, comments were solicited from interested parties, including City agencies, private utilities and the applicable area commission, before it was determined that, subject to the retention of a general utility easement for those utilities currently located within these rights-of-way, the City will not be adversely affected by the vacation of  these rights-of-way.

To vacate the rights-of-way identified as an approximate 0.099 acre portion of the unnamed 30 foot wide east/west right-of-way east of Nelson Road between Franklin Park South and Bryden Road, and an approximate 0.269 acre portion of the unnamed 20 foot wide north/south right-of-way located east of Nelson Road between Franklin Park South and Bryden Road to facilitate improvements and enhancements to the city-owned property, known as Academy Park, located adjacent to both sides of these rights-of-ways.

 

Body

 

WHEREAS, the approximate 0.099 acre portion of the unnamed 30 foot wide east/west right-of-way east of Nelson Road between Franklin Park South and Bryden Road, and an approximate 0.269 acre portion of the unnamed 20 foot wide north/south right-of-way located east of Nelson Road between Franklin Park South and Bryden Road, are publicly dedicated rights-of-way currently controlled by the Department of Public Service, and

 

WHEREAS, the City of Columbus, Department of Public Service, received a request from the Department of Recreation and Parks, asking that the City vacate these  public rights-of-way to the Department of Recreation and Parks to facilitate the proposed improvements and enhancements to the City’s Academy Park; and

 

WHEREAS, the City of Columbus, Department of Public Service, Division of Infrastructure Management, has determined that  these areas are no longer needed for roadway purposes and wishes to vacate the aforementioned rights-of-ways; and

 

WHEREAS, per Department of Public Service current practice, comments were solicited from interested parties, including City agencies, private utilities and applicable area commissions, before it was determined that  the City will not be adversely affected by the vacation of these rights-of-way; and

 

WHEREAS, it is necessary to vacate the aforementioned right-of-way; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the approximate 0.099 acre portion of the unnamed 30 foot wide east/west right-of-way located east of Nelson Road between Franklin Park South and Bryden Road, and an approximate 0.269 acre portion of the unnamed 20 foot wide north/south right-of-way located east of Nelson Road between Franklin Park South and Bryden Road are no longer needed by the City of Columbus for roadway purposes.

 

Section 2. That the above described sections of public right-of-way be vacated.

 

Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
