Explanation

BACKGROUND: This ordinance authorizes the repeal of ordinance 0251-2016, passed on February 22, 2016, to appropriate funds in the Indigent Drivers Alcohol Treatment Fund to provide funds for accident investigation training courses and the Driving While Impaired (DWI) Enforcement Conference for officers in the Traffic Bureau. The funds were deposited in the Indigent Drivers Alcohol Treatment Fund pursuant to Ohio Revised Code 4511.99. However, ORC Code 4511.99 has been amended removing the language that distributed a portion of that fund to the arresting agency. Therefore, CPD’s Traffic Bureau is not entitled to the funds.

Emergency Designation: Emergency legislation is requested so that the ordinance can be repealed and the appropriation can be cancelled allowing the monies to be returned.

FISCAL IMPACT: This cancellation will make available $119,659.81 from the Indigent Drivers Alcohol Treatment Fund that will be returned to the Franklin County Municipal Court.

WHEREAS, ordinance 0251-2016, passed on February 22, 2016, authorized an appropriation of $119,659.81 from the unappropriated balance of the Indigent Drivers Alcohol Treatment Fund for the Division of Police to pay for advanced training for the Accident Investigation Unit and a DWI Conference for Traffic Bureau personnel, as well as to purchase supplies and equipment; and

WHEREAS, Ohio Revised Code 4511.99 has been amended removing language that allowed for a percentage of the money collected in the Indigent Drivers Alcohol Treatment Fund to go to the arresting agency to be used for training and supplies; and

WHEREAS, it is now necessary to repeal said ordinance and cancel the appropriation so that the funds can be returned to the Franklin County Municipal Court; and
