Explanation
BACKGROUND:
The City owns fee simple title to a parcel of real property located along Mound Street and Interstate 70, Columbus, Ohio 43215, identified as Franklin County Tax Parcel 010-020231 (“Property”), managed by the Department of Finance and Management (“Finance”) that is encumbered by a highway easement benefitting the State of Ohio, Department of Transportation (“ODOT”). ODOT is undertaking certain improvement and maintenance to the public right-of-way of Interstate 70 adjacent to the Property (“Public Project”) which necessitate ODOT acquisition of fee simple title to the entire Property in order to complete the Public Project.
The Department of Finance and Management has reviewed ODOT's request and supports granting the Property to ODOT for the Public Project to foster intergovernmental and benefit the public through the improvement of the adjacent I-70 public right-of-way subject to the reservation of a general utility easement to the City in order to maintain all existing utilities located in, on, over, under, adjacent, through, and burdening the Property.

To authorize the Director of the Department of Finance and Management to execute and acknowledge any necessary document(s), as approved by the City Attorney, in order to grant to the State of Ohio, Department of Transportation all of the City’s real property located along Mound Street and Interstate 70, Columbus, Ohio 43215, identified as Franklin County Tax Parcel 010-020231, in order to improve and maintain the public right-of-way of Interstate-70. WHEREAS, the City owns fee simple title to a parcel of real property located along Mound Street and Interstate 70, Columbus, Ohio 43215, identified as Franklin County Tax Parcel 010-020231 that is encumbered by a highway easement and desires to support the State of Ohio, Department of Transportation (ODOT) Public Project for the improvement and maintenance of the public right-of-way of Interstate 70; and
WHEREAS, the City desires to grant fee simple title to the Property to ODOT subject to the reservation of a general utility easement to the City in order to maintain all existing utilities located in, on, over, under, adjacent, and through the Property; and
WHEREAS, it has been determined that it is in the City's best interest to grant ODOT fee title to the City’s real property located along Mound Street and Interstate 70, Columbus, Ohio 43215, identified as at Franklin County Tax Parcel 010-020231, to foster intergovernmental and benefit the public through the improvement of the adjacent I-70 public right-of-way; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Finance and Management to authorize the Director to execute and acknowledge any necessary documents to grant said property; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS, OHIO:
SECTION 1. The Director of the Department of Finance and Management is authorized to execute and acknowledge any document(s) necessary to quit-claim grant to the State of Ohio, Department of Transportation fee simple title to that City-owned real property located along Mound Street and Interstate 70, Columbus, Ohio 43215, identified as Franklin County Tax Parcel 010-020231, in order for ODOT to improve and maintain the public right-of-way of Interstate-70.
SECTION 2. The City’s grant of fee simple title to ODOT, pursuant to this ordinance, is subject to the City’s reservation of a general utility easement in order to maintain all existing utilities located in, on, over, under, adjacent, through, and burdening the Property.
SECTION 3. The City Attorney is required to approve all instrument(s) associated with this ordinance prior to the director of Finance executing and acknowledging any of those instrument(s).
SECTION 4. This ordinance shall take effect and be in full force and effect from and after the earliest period allowed by law.
