Explanation

BACKGROUND:  This ordinance authorizes the modification of the contract approved through Ordinance 0835-2015 for the purchase of one (1) midship mounted aerial platform and equipment for the Division of Fire from Sutphen Corporation.  The Division of Fire will utilize this platform ladder truck as a first responder on all multiple alarm fires.

 

Ordinance 0835-2015 was passed July 16, 2015 to authorize the purchase of one (1) midship mounted aerial platform and equipment for the Division of Fire from Sutphen Corporation.  Based upon the authorization granted by Ordinance 0835-2015, the Finance and Management Director signed a contract with Sutphen Corporation for this purchase (FL006296).

 

Bid Information:    In 2013, a Formal Request for Proposal (RFP) was solicited (SA004849) for the purchase of one (1) midship mounted aerial platform, and evaluated by a seven (7) member committee.  An award recommendation was made to Sutphen Corporation, via Ordinance 1827-2013 which passed on 09/26/13.  Sutphen Corporation honored the same price quoted to the Division of Fire in 2013, for the purchase of this midship mounted aerial platform purchased in 2015 (FL006296), which was authorized by Ordinance 0835-2015.  Competitive bidding was waived at that time so the Division of Fire could purchase the same vehicle and equipment as was previously ordered in 2013.  However, modifications to the midship mounted aerial platform ladder truck were made after the contract was signed, necessitating Council action for approval of this modified contract. 

 

Contract Compliance:  Sutphen Corporation (#31-0671786) - Active C.C. 04/21/2017

 

Emergency Designation:  The Division of Fire requests emergency legislation so that the payment for one (1) midship mounted aerial platform and equipment can happen immediately.  The platform ladder truck is currently under construction with an estimated completion date of May 1, 2016.

 

FISCAL IMPACT:  Ordinance 0835-2015 authorized the expenditure of $1,199,768.19 from the Fire Division’s Safety Bond Platform Replacement Fund.  Due to an increase in various equipment costs, a modification to the contract of $9,432.99 is necessary.  This ordinance also amends the 2015 Capital Improvement Budget to properly align appropriations with projected expenditure.

 

Title

To amend the 2015 Capital Improvement Budget; to authorize the Finance and Management Director to modify a contract with Sutphen Corporation for the purchase of one (1) midship mounted aerial platform and equipment for the Fire Division (FL006296); and to declare an emergency.  ($9,432.99)

 

Body

WHEREAS, City Council approved the purchase of one (1) midship mounted aerial platform and equipment for use by the Fire Division in Ordinance 0835-2015; and

 

WHEREAS, a modification of the contract is necessary to accept the midship mounted aerial platform and equipment to be delivered in May 2016; and

 

WHEREAS, it is necessary to amend the 2015 Capital Improvement Budget to properly align appropriation with projected expenditure; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Safety, Division of Fire, in that it is immediately necessary to authorize and direct the Director of Finance and Management to enter into a contract modification with Sutphen Corporation for the purchase of one (1) midship mounted aerial platform and equipment for use in emergency services for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2015 Capital Improvement Budget be amended in Fund 7701 as follows:

Project Name: Fire Apparatus Replacement - Platform Ladders| Project Number: 340101-100003 Voted Debt| Current Authority: $0| Revised Authority: $9,433| Difference: $9,433

 

SECTION 2. That the Finance and Management Director is hereby authorized to modify the contract with Sutphen Corporation (FL006296) for the purchase of one (1) midship mounted aerial platform and equipment, as per the terms listed in the attachment.

 

SECTION 3.  That the expenditure of $9,432.99, or so much thereof as may necessary, is hereby authorized from the Safety Bond Fund, as per the accounting codes in the attachment to this ordinance.

SECTION 4. That the funds necessary to carryout the purpose of this ordinance are hereby deemed appropriated and the City shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering such project that the project has been completed and the monies are no longer required for said project.

 

SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
