Title: To authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a lease termination agreement with the Columbus Metropolitan Library and to declare an emergency.

Explanation

 

Background: The Columbus Metropolitan Library’s (CML) renovation of its Main Library, located at 96 South Grant Street, necessitated the temporary relocation of its administrative offices during construction. To meet CML’s need for temporary administrative office space, the City and CML entered into a short-term Lease Agreement, dated December 24, 2014, for office space located on the second floor at 1111 E. Broad Street, the Jerry Hammond Center. It was estimated that the construction would require temporary relocation of administrative staff for a period of twenty (20) months. The renovation of the Main Library is ahead of schedule and will be ready for occupancy earlier than originally anticipated. CML has requested early termination of its Lease which terminates on August 31, 2016.  The City’s best interests are served by supporting CML and granting its request for early termination of the Lease. This legislation authorizes the Director of the Department of Finance and Management to enter into a lease termination agreement with the Columbus Metropolitan Library to terminate the Lease effective June 30, 2016.

 

Fiscal Impact: The City will not receive rental funds as planned for July and August ($21,916.68) that support the operation of the Jerry Hammond Center.

 

Emergency action is requested to allow the Columbus Metropolitan Library sufficient time to make all arrangements necessary to move its personal property and data services in a timely manner to meet the June 30, 2016 lease termination date.

To authorize the Director of the Department of Finance and Management to execute those documents necessary to enter into a lease termination agreement with the Columbus Metropolitan Library and to declare an emergency.

 

Body

 

WHEREAS, the City owns that real property located at 1111 E. Broad Street; and

 

WHEREAS, the City and Columbus Metropolitan Library (CML) entered into that certain Lease Agreement dated December 24, 2014 to provide for temporary relocation of its administrative offices during the construction and renovation of the Main Library; and

 

WHEREAS, the renovation of the Main Library is ahead of schedule for completion and will be ready for occupancy earlier than originally anticipated; and

 

WHEREAS, the Columbus Metropolitan Library has requested early termination of its Lease Agreement for office space located at 1111 E. Broad Street, the Jerry Hammond Center; and

 

WHEREAS, the City’s best interests are served by supporting CML and granting its request for early termination of the Lease; and

 

WHEREAS, the City and CML desire to enter into a lease termination agreement to terminate the Lease effective June 30, 2016; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management, Real Estate Management Office, that it is necessary to authorize the Director of the Department of Finance and Management to execute, on behalf of the City, those documents necessary to enter into a lease termination agreement with the Columbus Metropolitan Library to provide for a lease termination with an effective date of June 30, 2016 and for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore;

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1. That the Director of the Department of Finance and Management, on the behalf of the City, be, and hereby is, authorized to execute those documents as approved by the Department of Law, Division of Real Estate, necessary to enter into a lease termination agreement by and between the City of Columbus and the Columbus Metropolitan Library (CML) to terminate the Lease Agreement, dated December 24, 2014, for office space located at 1111 E. Broad Street, Jerry Hammond Center, used as temporary CML administrative offices during the renovation of the Main Library.

 

SECTION 2. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
