Explanation

 

1.  BACKGROUND

This legislation authorizes the Director of the Department of Public Service to modify an existing cooperative agreement with Delaware County for the purpose of contributing additional funds for right-of-way acquisition and utility relocation for the Intersection Improvements - South Old State at Polaris Parkway project.

 

Ordinance 2564-2014 authorized the Director of Public Service to enter into a cooperative right-of-way acquisition and utility relocation agreement with Delaware County for the Intersection Improvements - South Old State at Polaris Parkway project.  This is a joint project between Delaware County, City of Columbus, and the Ohio Department of Transportation (ODOT).  The purpose of this project is to widen and reconstruct 2.08 miles of South Old State Road to a five lane section with associated turn lanes between a point approximately 1,300 feet south of Polaris Parkway to a point approximately 1,500 feet north of Orange Road.  The project will incorporate new pavement, curb, sidewalk, shared use path, drainage, lighting, and traffic signals.

 

As part of the original cooperative agreement, Delaware County is to acquire the right-of-way and coordinate utility relocation attributable to the project within the project boundaries, including the boundaries in Columbus’ jurisdiction.  Utility relocation and right-of-way costs for the Columbus portion of the project are now expected to exceed the original estimate of $200,000.00.  The current estimate for the Columbus right-of-way acquisition and utility relocation costs project an additional $100,000.00 is needed to complete these tasks.

 

2.  FISCAL IMPACT

Funds are available and were budgeted within the Department of Public Service 2016 Capital Improvement Budget in Fund 7704, Streets and Highways Improvement Bond Fund. 

 

3.  EMERGENCY DESIGNATION

This project is scheduled to be constructed in 2017.  Emergency action is requested so that Delaware County may maintain their project schedule.

Body

 

WHEREAS, the Delaware County Engineer's office has identified the need for the DEL-CR10-0.90 (PID 90243) improvement project; and

 

WHEREAS, a part of the DEL-CR10-0.90 (PID 90243) improvement project is within the Columbus corporate boundaries; and

 

WHEREAS, the City authorized Delaware County to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus; and

 

WHEREAS, the estimated additional project cost for the right-of-way acquisition and utility relocation for the City of Columbus’ portion is $100,000.00; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to modify a cooperative right-of-way acquisition and utility relocation agreement with Delaware County in order to to meet the project schedule for the DEL-CR10-0.90 (PID 90243) improvement project for the safety of the travelling public, for the public health, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Public Service be and is hereby authorized to modify a cooperative right-of-way acquisition and utility relocation agreement with Delaware County for the Intersection Improvements - South Old State at Polaris Parkway project.

 

SECTION 2.  That the expenditure of $100,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 Streets and Highways G.O. Bonds Fund in object class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
