Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to modify and increase an existing contract with E.P. Ferris & Associates, Inc. for the Signal Installation - General Engineering contract in an amount up to $80,000.00.   

 

Ordinance 0152-2012 authorized the contract with E. P. Ferris and Associates, Inc. to provide the Department of Public Service with engineering and design resources to prepare engineering documents as part of the Signal Installation - General Engineering project.

 

Work performed to date for this project includes the preliminary engineering study and meetings with primary stakeholders of the project and detailed design and construction plan preparation services for improvements to High Street from Convention Center Drive to Goodale Street.

The total of Modification No. 1:                                   $80,000.00      (Current Ordinance)

The contract amount including all modifications:          $580,000.00  

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against E.P. Ferris & Associates, Inc.  

 

2. PLANNED MODIFICATION

This is a planned modification and will provide engineering resources for the:  Preliminary Alignment plans, Combined Stage 1-2 plans, Stage 3 Plans, and Final Plans for the task labeled Signal Installation-Central College Road at Harlem Road.  The scope for this task changed due to additional traffic counts added to the intersection after the original design was started because of a newly proposed residential development in the project area.

 

If additional phases are pursued and/or additional funds are needed to complete the design, the Director shall seek Council approval to modify this contract and expend additional funds.

 

3.  CONTRACT COMPLIANCE

The contract compliance number for E.P. Ferris & Associates, Inc. (Vendor Number 004467) is 31-0922991 and expires on 3/13/17.

 

4.  FISCAL IMPACT

Funds in the amount of $80,000.00 are available for this project in the Streets and Highways G.O. Bond Fund within the Department of Public Service’s 2016 Capital Improvement Budget. 

 

5.  EMERGENCY DESIGNATION

Emergency action is requested to provide necessary design funding to prevent delays in the Department of Public Service’s Capital Improvement Program.

Body

WHEREAS, contract no. EL012451 with E.P. Ferris & Associates, Inc. in the amount of $500,000.00, was authorized by ordinance no. 0152-2012; and

 

WHEREAS, the Department of Public Service has determined it to be in the City's best interest to modify the subject contract in an amount up to $80,000.00 for the purpose of performing additional design services for Signal Installation - Traffic Signal General Engineering; and

 

WHEREAS, this is a planned modification and the Director of Public Service may request additional, future planned modifications for additional design services; and

 

WHEREAS, the total contract amount, including this modification, is $580,000.00; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to modify the contract with E.P. Ferris & Associates, Inc. so that funding can be made available to allow the project to proceed on time, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL012451, with E.P. Ferris & Associates, Inc., 880 King Avenue, Columbus, OH 43212, by up to $80,000.00 for additional work in accordance with the terms as shown on the contract modification on file in the Office of Support Services.

                     

SECTION 2.  That the expenditure of $80,000.00 or so much thereof as may be needed, is hereby authorized in Fund 7704 Streets and Highways G.O. Bond Fund in Object Class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
