Title: To authorize the Finance and Management Director to modify the Universal Term Contract (UTC) with VWR International, LLC by amending the freight terms to add temperature fees; and to declare an emergency.

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify an existing city-wide Universal Term Contract (UTC) with VWR International LLC to allow for the addition of freight terms for temperature fees.  VWR International provides laboratory supplies for the Departments of Health and Public Safety.  Several of the supplies are temperature sensitive and require specific shipping packaging which is more expensive than traditional laboratory supply shipping and therefore increases costs. The temperature sensitive fee was not anticipated under the original UTC contract with VWR International.  This legislation will authorize a modification so that these temperature sensitive fees can be paid.  Per ordinance 1117-2015 VWR International, LLC was awarded Lab Supplies UTC according to the specifications of the original solicitation SA005769 and will expire May 30, 2018. VWR International LLC. did not include the temperature fees on the original solicitation SA005769.  Upon further research, the Purchasing office has determined that temperature fees are normal within industry and would therefore be appropriate to include.

Seven of the items will include a shipping cost of $8.00; one item will include a shipping cost of $10.00; the last item will include a shipping cost of $45.00.

This ordinance is being submitted as an emergency because, without emergency action, no less than 37 days will be added to this procurement cycle and the efficient ordering and delivery of lab supplies could be interrupted.

FISCAL IMPACT: No funding is required to modify the option contract. The temperature fee will include an additional shipping cost of $8.00 per item for seven of the laboratory supplies.  Two supplies will include a temperature fee of $10.00  and $45.00 per item respectively.

EMERGENCY LEGISLATION:  The Purchasing office respectively request this ordinance be considered as an emergency to that the laboratory supplies necessary for the Departments of Health and Public Safety may continue to be ordered without interruption.

To authorize the Finance and Management Director to modify the Universal Term Contract (UTC) with VWR International, LLC by amending the freight terms to add temperature fees; and to declare an emergency.

Body

 

WHEREAS, it is necessary to modify the existing contract with VWR International, LLC to include freight terms for the addition of temperature fees; and

WHEREAS, VWR International, LLC has agreed to amend the current contract, FL006231, to include temperature fees quoted by the vendor on an as need basis; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to authorize the Director to modify the contract with VWR International, LLC, FL006231 for inclusion of the laboratory supply temperature fees; now, therefore:

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That the Finance and Management Director is hereby authorized to modify the contract with VWR International, LLC, FL006231, to include freight terms for the addition of temperature fees.

SECTION 2.  All other terms and conditions of the contracts remain the same.

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
