Explanation

 

1.0 BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Complete General Construction Co. for the Broad Meadows Underground Street Lighting Improvements Project, in an amount up to $86,112.40, for the Division of Power. 

 

This project consists of installing a street lighting system with underground wiring under the assessment procedure.  Property owners have submitted a petition for a light-emitting diode (LED) street lighting system with ornamental poles and underground wiring for the Broad Meadows - Highfield Drive area. 

 

The Planning Area for this project is “Far North” and includes the Highfield Drive area, including: Highfield Drive, Milton Avenue from Highfield Drive, to and including parcel numbers 010-110713 and 010-110714.

 

Resolution No. 0045X-2011, adopted April 11, 2011, authorized the preparation of plans and specifications.  Emergency declaration of necessity, Resolution Number 0157X-2016 was adopted July 11, 2016.  Ordinance Number 3224-2016, determining to proceed, was passed January 9, 2017.

 

2.0 ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT: This work is being performed with the City of Columbus’s goal to light every street.  The addition of street lighting within the Broad Meadows area could provide both a sense of security and additional visibility on the roadways.  This may also deter criminal activity, which would lessen the financial impact on city resources such as the Police and Fire departments. 

 

3.0 CONSTRUCTION CONTRACT AWARD: The Director of Public Utilities publicly opened four bids on March 1, 2017 from:

1.                     Complete General Construction Co.                     $  86,112.40

2.                     Jess Howard Electric Co.                     $  96,854.27

3.                     U.S. Utility Contractors                     $  97,838.21

4.                     Vaughn Industries LLC                     $220,874.12

 

3.1 PRE-QUALIFICATION STATUS: Complete General Construction Co. has met code requirements with respect to pre-qualification, pursuant to relevant sections of Columbus City Code Chapter 329.  There are no proposed subcontractors on this project.

 

Complete General Construction Co.’s bid was deemed the lowest, best, most responsive and responsible bid in the amount of $86,112.40.  Their Contract Compliance Number is 31-4366382 (expires 9/14/17, Majority, DAX No. 006056).  Additional information regarding all bidders, description of work, contract time frame and detailed amounts can be found on the attached Information form.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Complete General Construction Co.

 

4.0 EMERGENCY DESIGNATION: Emergency action is requested due to the property owners’ approved petition for a timely implementation of construction services.

 

5.0 FISCAL IMPACT:  The determined amount to be paid for the City's Share under this project is $48,787.00 and will require a transfer within the Electricity G.O. Bonds Fund.  This legislation is contingent upon the passage of Ordinance No. 0727-2017 which authorizes the issuance and sale of special assessment bond anticipation notes to cover the property owners’ share.

Body

 

WHEREAS,  property owners have submitted a petition for a light-emitting diode (LED) street lighting system with ornamental poles and underground wiring for the Broad Meadows - Highfield Drive area; and

 

WHEREAS, the Broad Meadows area includes the Highfield Drive area, including: Highfield Drive, Milton Avenue from Highfield Drive, to and including parcel numbers 010-110713 and 010-110714; and

 

WHEREAS, the lowest, best, most responsive and responsible bid was from Complete General Construction Co. in the amount of $85,112.40; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract for the Broad Meadows Underground Street Lighting Improvements Project; and

 

WHEREAS, it is necessary to authorize a transfer an expenditure of funds within the Electricity G.O. Bonds Fund to provide for the City's share in the cost of installing a street lighting system with underground wiring in the Broad Meadows Area under the assessment procedure; and

 

WHEREAS, this Ordinance is contingent upon passage of Ordinance No. 0727-2017 which authorizes the issuance and sale of special assessment bond anticipation notes; and

 

WHEREAS, it is necessary to authorize the appropriation and expenditure of the proceeds from the special assessment bond anticipation notes; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power, in that it is immediately necessary to enter into a construction contract with Complete General Construction Co. for the Broad Meadows Underground Street Lighting Improvements Project, in an emergency manner in order to complete financial transactions and enter into a contract to comply with property owners’ approved petition for timely implementation of construction services, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities be and hereby is authorized to award and execute a construction contract for the Broad Meadows Underground Street Lighting Improvements Project, with Complete General Construction Co., 1221 E. Fifth Ave., Columbus, Ohio, 43219; in an amount up to $86,112.40, in accordance with the terms and conditions of the contract on file in the Office of the Division of Power.

 

SECTION 2.  That said contractor shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power.

 

SECTION 3. That the transfer of $48,787.00 or so much thereof as may be needed, is hereby authorized between projects within Fund 6303 - Electricity G.O. Bond Fund, per the account codes in the attachment to this ordinance.

 

SECTION 4. That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2017, the sum of $62,000.00* is appropriated in Fund 6312 - Electricity Assessment Fund, in Object Class 06 - Capital Outlay, per the account codes in the attachment to this ordinance.  (*Rounded; $62,000 going towards part of Construction, Construction Administration/Inspection, and Interest.)

 

SECTION 5. That the appropriation and expenditure of $86,112.40 or so much thereof as may be needed, is hereby authorized in Object Class 06 - Capital Outlay, per the accounting codes in the attachment to this ordinance.

 

SECTION 6.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 10.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
