Explanation

 

BACKGROUND: This ordinance authorizes the Director of Public Safety to enter into a contract with Meggitt Training Systems, Inc. for the upgrade the indoor shooting range system for the Division of Police.

 

The Columbus Division of Police renovated the indoor shooting range with bond funds in 2011 by upgrading the running target and trap system of the range. This upgrade is necessary as the company no longer makes or is able to fix any existing problems that may arise with regards to the old system.  The XWT carrier system that will be upgraded is a mechanical carrier system that manipulates targets within the range and offer Police officers accurate and realistic targets on which to practice. All internal mechanical equipment, external armor and all target stations will be upgraded. This upgrade will ensure that the Columbus Division of Police continues to be compliant with State Mandates. 

 

Bid Information:  This contract is awarded pursuant to the sole source provisions of Chapter 329 of Columbus City Code due to the proprietary nature of Meggitt Training Systems, Inc., as they have the necessary expertise and can upgrade the existing system that was previously installed by Meggitt Training Systems, Inc., The conversion to a new system will be cost prohibitive.

 

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

Emergency Designation: Emergency legislation is requested so that the Division of Police may upgrade the indoor shooting range system in order to maintain functionality of the range so the Division of Police can remain in compliance with all State and Division mandated requirements with regards to firearms certifications.   

 

FISCAL IMPACT:  This ordinance authorizes an expenditure of $235,263.39 with Meggitt Training Systems, Inc. from the Public Safety Capital Improvement Budget Fund for the indoor shooting range upgrade system.  The Department of Public Safety, Division of Police budgeted $235,263.39 in the capital fund for this upgrade.

 

Title

To amend the 2016 Public Safety Capital Improvement Budget; to authorize a transfer of funds between projects within the Public Safety Capital Improvement Budget; to authorize and direct the Director of Public Safety to enter into contract with Meggitt Training Systems, Inc. for the upgrade of the indoor shooting range system for the Division of Police in accordance with the sole source provisions of Columbus City Code; to authorize the expenditure of $235,263.39 within the Public Safety Capital Improvement Fund; and to declare an emergency. Body

 

WHEREAS, it is necessary to amend the 2016 Public Safety Capital Improvement Budget and to authorize the transfer of funds between projects within the 2016 Public Safety Capital Improvement Budget; and

 

WHEREAS, the Division of Police needs to enter into contract with Meggitt Training Systems, Inc. for the upgrade of the indoor shooting range system; and

 

WHEREAS, it is necessary to use Meggitt for the upgrade to the indoor shooting range system, in accordance with sole source provisions of Chapter 329, due to the proprietary nature of the technology and prohibitive cost of conversion to a different system;  and

 

WHEREAS,  the indoor shooting range system is an invaluable tool for law enforcement for meeting State and Division mandated requirements with regards to firearms certifications; and

 

WHEREAS, funds budgeted in the Public Safety Capital Improvement Fund will be used to upgrade the Division of Police indoor shooting range system; and

 

WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to enter into a contract with Meggitt Training Systems, Inc. for the upgrade of the indoor shooting range system for the immediate preservation of the public peace, property, health, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2016 Capital Improvement Budget be amended in fund 7701 as follows:

 

Project Name - Police Facility - Central Safety Bureau (Councilmanic SIT Supported) / Project ID Number 330043-100000 / Current Authority $635,000 / Revised Authority $433,756/ Difference: ($201,244)

Project Name - Police Equipment (Voted Carryover) / Project ID Number 330036-100000/ Current Authority $8.00 / Revised Authority $34,020 / Difference: ($34,012) To account for a cancellation.

Project Name - Police Equipment (Councilmanic SIT Supported) / Project ID Number 330036-100000/ Current Authority $0.00/ Revised Authority $201,244/ Difference: $0.00

SECTION 2.  That the transfer of $201,243.39, or so much thereof as may be needed, is hereby authorized within Fund 7701, Public Safety Capital Improvement Fund per the accounting codes in the attachment to this ordinance.

SECTION 3. That the Director of Public Safety be and is hereby authorized and directed to enter into contract with Meggitt Training Systems, Inc. for the upgrade of the indoor shooting range system for the Division of Police, Department of Public Safety in accordance with the sole source provisions of Columbus City Code.

 

SECTION 4. That the expenditure of up to $235,263.39, or so much as thereof as may be necessary in regard to the action authorized in SECTION 3, is hereby authorized in the Public Safety Capital Improvement Fund,

 

SECTION 5. That said agreement shall be awarded in accordance with sole source provisions of City Code Chapter 329.

 

SECTION 6. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer for said project.

 

SECTION 9. That for reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
