Explanation

 

1.  BACKGROUND

The purpose of this ordinance is to amend the easement agreement with Nationwide Mutual Insurance Company for the Nationwide Walkway Transfer and Agreement in order to allow Nationwide Mutual Insurance Company and the City to clarify when the pedestrian connector needs to be accessible and open to the public.

 

Ordinance 1019-2007 authorized the Director of Finance and Management to enter into a guaranteed maximum cost reimbursement agreement with Nationwide Mutual Insurance Company, authorized the Director of Public Service to grant Nationwide Mutual Insurance Company an aerial encroachment easement for the overhead walkways, and conveyed title to the connecting structures to Nationwide Mutual Insurance Company.  Nationwide Mutual Insurance Company desires to amend the easement agreement for the 0.039 acre pedestrian connector easement area, as recorded within instrument number 201110120129594.  The amended agreement will allow Nationwide Mutual Insurance Company and the City to clarify when the pedestrian connector needs to be accessible and open to the public.  After investigation by the Department of Public Service, it has been determined that the amendment of this agreement easement will not adversely affect the City and will help maintain a safer environment for the general public.  The following legislation authorizes the Director of the Department of Public Service to execute those documents necessary to amend the easement agreement as described within the recorded instrument number 201110120129594.

Body

WHEREAS, as part of the Nationwide Walkway Transfer and Agreement, dated January 2008, authorized by Ordinance 1019-2007, Nationwide Mutual Insurance Company desires to amend the easement agreement for the 0.039 acre pedestrian connector easement area, as recorded within instrument number 201110120129594; and

 

WHEREAS, the amended agreement will allow Nationwide Mutual Insurance Company and the City to clarify when the pedestrian connector needs to be accessible and open to the public; and

 

WHEREAS, after investigation by the Department of Public Service, it has been determined that the amendment of this agreement easement will not adversely affect the City and will help maintain a safer environment for the general public; and

 

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary to amend the easement agreement as described within the recorded instrument number 201110120129594; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That this Council hereby authorizes the Director of the Department of Public Service to execute those documents necessary to amend the easement agreement recorded as instrument number 201110120129594 at the recorder’s office, Franklin County, Ohio, as approved by the City Attorney’s Office, Real Estate Division.

 

SECTION 2.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
