Explanation

1.  BACKGROUND

This ordinance authorizes the Director of the Department of Public Service to execute a contribution agreement with and accept monies from the Stonehenge Company to support the design and construction of certain infrastructure in connection with the Arterial Street Rehabilitation - Hamilton Road - SR 161 to Morse Road Phase A project, and to, as necessary, provide a refund to the Stonehenge Company after final accounting is complete.

 

The aforementioned project represents the first of multiple phases of improvements to the North Hamilton Road corridor from Morse Road to SR 161 and intersecting arterial roadways, Morse Road and Dublin-Granville Road, geared toward increasing vehicular capacity, extending bikeway facilities, and completing gaps in the pedestrian system.

 

The Stonehenge Company has requested a traffic signal be installed at the intersection of Blendon Place Drive and Hamilton Road to facilitate ingress to and egress from a future development on the east side of Hamilton Road as part of Arterial Street Rehabilitation - Hamilton Road - SR 161 to Morse Road Phase A project and has agreed to contribute funding toward associated design and construction costs.

 

2.  FISCAL IMPACT

Stonehenge shall contribute $360,000.00 to support design and construction costs associated with the installation of a traffic signal at the intersection of Blendon Place Drive and Hamilton Road as part of the Arterial Street Rehabilitation - Hamilton Road - SR 161 to Morse Road Phase A project. 

 

3.  EMERGENCY DESIGNATION

Emergency action is requested in order to allow for immediate execution of agreements necessary to facilitate the design and construction of said public improvements in a timely manner.

Body

WHEREAS, the Department of Public Service proposes constructing various improvements to the North Hamilton Road corridor from Morse Road to SR 161 and intersecting arterial roadways, Morse Road and Dublin-Granville Road, geared toward increasing vehicular capacity, extending bikeway facilities, and completing gaps in the pedestrian system; and

 

WHEREAS, the Stonehenge Company has proposed the installation of a traffic signal at the intersection of Blendon Place Drive and Hamilton Road to facilitate ingress to and egress from a future development on the east side of Hamilton Road as part of the Arterial Street Rehabilitation - Hamilton Road - SR 161 to Morse Road Phase A project; and

 

WHEREAS, this ordinance authorizes the Director of Public Service to execute an agreement with and accept monies from the Stonehenge Company toward associated design and construction costs; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to execute the aforementioned contribution agreement so as to prevent unnecessary delays in the completion of the aforementioned public improvements, thereby preserving the public health, peace, property, safety and welfare; now therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Public Service be and hereby is authorized to enter into an agreement with the Stonehenge Company relative to the Arterial Street Rehabilitation - Hamilton Road - SR 161 to Morse Road Phase A project, to accept contributions from the Stonehenge Company to support work performed as part of that project; and to, as necessary, provide a refund to the Stonehenge Company after final accounting is complete.

 

SECTION 2.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2017, the sum of $360,000.00 is appropriated in Fund 7766 Street and Highway Improvements (Non-Bond) Fund per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
