Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to enter into a contract with Columbus Asphalt Paving Inc. for the construction of the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927 and to provide payment for construction administration and inspection services

 

The scope of improvements for the Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927 consists of: relocating four COTA bus stops, including the construction of two bus pull-offs (one on Livingston Avenue east of Hamilton Road and one on Hamilton Road south of Livingston Avenue).  There will also be installation of new signage warning pedestrians to watch for vehicles and drivers to yield as well as crosswalk modifications.  There will also be the installation of sidewalk on Hamilton Road and Livingston Avenue to connect the new bus stop locations to exiting walk and service roads adjacent to bus pull off areas, and other such work as may be necessary to complete the contract in accordance with the plans and specifications set forth in the Bid Submittal Documents. 

 

The estimated Notice to Proceed date is July 28, 2017.  The project was let by the Office of Support Services through Vendor Services and Bid Express.  Three bids were received on May 25, 2017 (all majority) and tabulated as follows:

Award is to be made to Columbus Asphalt Paving Inc., as the lowest, responsive, responsible and best bidder for their bid of $283,533.87.  The amount of construction administration and inspection services will be $28,353.39.  The total legislated amount is $311,887.26.

 

Searches in the System for Award Management (Federal) and the Findings for Recovery list (State) produced no findings against Columbus Asphalt Paving Inc. 

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Columbus Asphalt Paving Inc. is CC57095-113743 (Vendor Number 004394) and expires 11/12/17.

 

3.  PRE-QUALIFICATION STATUS

Funding for this project is from the Ohio Department of Transportation (ODOT) and ODOT does not allow prequalification requirements.  The bidder and subcontractors are exempt from the prequalification requirements under relevant sections of Columbus City Code Chapter 329.

 

4.  FISCAL IMPACT

A grant from the Ohio Department of Transportation in the amount of $255,180.48 will partially fund construction for this project.  Public Service will contribute a local share amount of $28,353.39 for construction and $28,353.39 for inspection, for a total of $56,706.78 from the Streets and Highway Bonds Fund, Fund 7704.  An amendment to the 2017 Capital Improvement Budget is required to establish sufficient budget authority for the project.

 

5.  EMERGENCY DESIGNATION

Emergency action is requested in order for the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927 project to proceed immediately to ensure the safety of the traveling public, thereby preserving the public health, peace, property, safety and welfare.

Body

WHEREAS, the City of Columbus Department of Public Service is engaged in the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927; and 

 

WHEREAS, work on this project consists of relocating four COTA bus stops, installing new signage, crosswalk modifications; installing a sidewalk on Hamilton Road and Livingston Avenue; and

 

WHEREAS, bids were received on May 25, 2017, and tabulated on May 26, 2017, for the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927, and a satisfactory bid has been received; and

 

WHEREAS, Columbus Asphalt Paving Inc. will be awarded the contract for the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927; and

 

WHEREAS, it is necessary to enter into contract with Columbus Asphalt Paving Inc.; and

 

WHEREAS, it is necessary to provide for construction administration and inspection services; and

 

WHEREAS, Federal Transportation grant funds will be used to pay for a portion of this project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to enter into contract with Columbus Asphalt Paving in order for the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project PID 100927 to proceed on schedule to ensure the safety of the traveling public, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1. That the 2017 Capital Improvements Budget authorized by ordinance 1124-2017 be amended as follows to establish  sufficient authority for this project:

SECTION 2.  That the transfer of $56,706.78, or so much thereof as may be needed, is hereby authorized between projects within Fund 7704 Streets and Highways G.O. Bonds Fund per the account codes in the attachment to this ordinance.

SECTION 3.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2017, the sum of $255,180.48 is appropriated in Fund 7765 Federal Transportation Grants Fund in object class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  That the Director of Public Service be and is hereby authorized to enter into contract with Columbus Asphalt Paving Inc., 1196 Technology Drive, Gahanna, Ohio 43230, for the Intersection Improvements - Hamilton Road at Livingston Avenue Safety Project.

SECTION 5.  That the expenditure of $255,180.48 or so much thereof as may be needed, is hereby authorized in Fund 7765 Federal Transportation Grants Fund in object class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 6.  That the expenditure of $56,706.78, or so much thereof as may be needed, is hereby authorized in Fund 7704 Streets and Highways Bond Fund in object class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 7.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 9.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 10.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
