Explanation

Background:

City Council adopted the University District Zoning Overlay Plan on May 1, 2017. Staff has identified a section of code from the previously adopted and recently repealed University Area Planning Overlay (Chapter 3372) that was intended to be included in the new University District Zoning Overlay (Chapter 3325) but was omitted. This ordinance brings the omitted section into the University District Zoning Overlay, as was originally intended. The section to be added, which is identical to previous code language, requires that “at least ten percent of the lot area be planted and maintained with grass and/or live vegetation and located behind the most rear portion of the principal residential building”. This requirement applies to the R2-F and R-4 zoning districts of the University District that lie outside of the Neighborhood Commercial and Regional Commercial subareas that were the primary focus of the recently adopted University District Zoning Overlay.

Title

Body

Whereas, by ordinance 1003-2017, Council adopted the University District Zoning Overlay; and

 

Whereas, staff has identified a section of code from Chapter 3372 that was intended to be included in the University District Zoning Overlay but was omitted; and

 

Whereas, including section 3372.541 (repealed) into the University District Zoning Overlay as section 3325.809 would constitute an administrative correction and would not introduce any new regulations or standards on property owners; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

                     

Section 1. That Columbus City Codes are hereby supplemented by the enactment of new Section 3325.809, reading as follows:

3325.809 - Landscaped Area and Treatment

At least ten percent of the lot area shall be planted and maintained with grass and/or other live vegetation and located behind the most rear portion of the principal residential building.

 

Section 2. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
