Explanation

 

BACKGROUND:  This ordinance authorizes the Finance and Management Director to enter into a contract for the purchase of weapons and accessories for the Division of Police’s SWAT unit and the INTAC unit from Vance Outdoors, Inc. as a result of competitive bidding.  The Division of Police needs to purchase forty (40) new Daniel Defense MK18 rifles with select fire capability. The rifles will be equipped with the following accessories; Radian Raptor-SD Ambidextrous charging handles, Midwest Industries MCTAR-SPLP rear low profile flip up locking iron site, and MI-LFFR-BLK front low profile flip up locking front iron site.

 

The specifications within the bid listed that there are thirty (30) rifles to be traded in and the value would be deducted from the total cost of the new weapons. There will be a $200.00 minimum trade-in value for each used Bushmaster Model XM15-E2S 5.56 full auto rifle. Trade must conform to ATF regulations.  The current rifles are at the end of life.

 

Bid Information:   Formal Bid RFQ005980 was opened on July 13, 2017.   Three responses were received as follows:

 

Vance Outdoors                      $64,000.00 less $7,500.00 trade-in equals $56,500.00

Clyde Armory Inc.                     $63,621.60 less $6,030.00 trade-in equals $57,591.60

Kiesler Police Supply    $64,155.60 less $4,500.00 trade-in equals $59,655.60

 

Based on the lowest, most responsive and best bid received, the Division of Police recommends that a contract be awarded to Vance Outdoors, Inc

 

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

 

Contract Compliance Number: CC009245, expires 7/6/2019.

 

EMERGENCY DESIGNATION: Emergency legislation is requested due to the immediate need required by the Division’s SWAT personnel.

 

FISCAL IMPACT:   This ordinance authorizes the purchase of forty (40) Daniel Defense MK18 rifles with select fire capability from Vance Outdoors, Inc. in the amount of $56,500.00 from the Law Enforcement Contraband Seizure Fund for the Division of Police. The funds were previously appropriated in the Law Enforcement Contraband Seizure Funds for this purchase.

Body

 

WHEREAS, a formal bid opening was held on July 13, 2017 for the purchase of forty (40) Daniel Defense MK18 Rifles and accessories for the rifles; and

 

WHEREAS, this ordinance authorizes the Director of Finance and Management to enter into a contract for the purchase of forty (40) Daniel Defense MK18 rifles with select fire capability for the Division of Police SWAT and INTAC Units; and

 

WHEREAS, Vance Outdoors bid included trade-in value of $7,500.00 for the thirty (30) used Bushmaster Model XM-15-E2S 5.56 full auto rifles, and

 

WHEREAS, Vance Outdoors, Inc. was the lowest, most responsive, and best bid received; and

 

WHEREAS, an emergency exists in the usual and daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to purchase these rifles and accessories for the immediate preservation of the public peace, health, property, safety and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Finance and Management be and is hereby authorized and directed to enter into a contract with Vance Outdoors, Inc. for the purchase of forty (40) Daniel Defense MK18 rifles and accessories for the rifles for the Division of Police, Department of Public Safety, based on the above vendor's bid being the lowest and best bid received.

 

SECTION 2. That the expenditure of $56,500.00, or so much thereof as may be needed, is hereby authorized as follows in Fund 2219 Law Enforcement Seizure Funds in object class 02 Supplies and Materials per the accounting codes in the spreadsheet attached to this ordinance

 

SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
