Explanation

 

BACKGROUND:

 

This ordinance authorizes the City, acting through its Director of the Department of Finance and Management, to enter into an Agreement For Management Of Parking Garage (the “Agreement”) with the Capitol South Community Urban Redevelopment Corporation (“Capitol South”), an Ohio nonprofit corporation, in conjunction with the management of the underground parking garage currently being built on the Scioto Peninsula in downtown Columbus (the “Parking Facility”).   

 

The Agreement is structured to allow Capitol South to manage the Parking Facility with the goal of providing affordable parking for downtown employees, guests and residents.

EMERGENCY JUSTIFICATION:

 

The Department of Finance and Management requests emergency designation to allow for the timely implementation of this agreement to meet the Fall 2017 target opening date.

Body

 

WHEREAS, the City intends to enter into an Agreement For Management Of Parking Garage (the “Agreement”) with Capitol South Community Urban Redevelopment Corporation (“Capitol South”) for the management of the parking garage on the Scioto Peninsula in downtown Columbus (the “Parking Facility”); and

 

WHEREAS, Capitol South has significant experience in managing downtown parking operations and extensive knowledge of the Parking Facility and the City’s requirements for its operation; and

 

WHEREAS, the Agreement is structured to allow Capitol South to manage the Parking Facility with the goal of providing affordable parking for downtown employees, guests and residents; and

 

WHEREAS, the City intends for the director of the Department of Finance and Management (“Finance”) to execute and acknowledge any document(s) necessary to enter into the Agreement; and

 

WHEREAS, the City intends for the City Attorney to approve all instrument(s) associated with this ordinance; and

 

WHEREAS, an emergency exists in the usual daily operations of the City in that it is immediately necessary to authorize the director of the Department of Finance and Management to execute and acknowledge any document(s), as approved by the City Attorney, necessary to enter into an Agreement For Management Of Parking Garage with Capitol South Community Urban Redevelopment Corporation, an Ohio nonprofit corporation, to allow for the timely implementation of this agreement to meet the Fall 2017 target date for opening the garage to the public, thereby preserving the public peace, property, health, welfare, and safety; and now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.                     The director of the Department of Finance and Management (“Finance”) is authorized to execute and acknowledge any document(s) necessary to enter into an Agreement For Management Of Parking Garage (the “Agreement”) with the Capitol South Community Urban Redevelopment Corporation (“Capitol South”), an Ohio nonprofit corporation, in conjunction with the management of the underground parking garage on the Scioto Peninsula in downtown Columbus (the “Parking Facility”).

 

SECTION 2.                     That Capitol South will charge a fee for its services against the Parking Facility’s operating expense and remit to the City on a regular basis all income received from the operation of the Parking Facility.

 

SECTION 3.                     That the City intends for the City Attorney to approve all instrument(s) associated with this ordinance.

 

SECTION 4. This ordinance, for the reasons stated in the preamble of this ordinance, which are fully incorporated for reference as if rewritten, is declared to be an emergency measure and is required take effect and be in force from and after its passage and approval by the Mayor or ten (10) days after its passage if the Mayor neither approves nor vetoes this ordinance.
