Explanation

AN17-013

 

BACKGROUND:  This ordinance is being submitted to authorize the Director of Development to file a municipal annexation petition for an 11.3± acre site in Franklin Township, Franklin County.  This property will be used by Franklin County as the new Franklin County Forensic Center.  The site is currently vacant.  Annexation will allow the construction and operation of the facility as well as any associated employment to take place within City limits. Additionally, this ordinance provides for the acceptance of the property by the City upon approval of the petition by the Franklin County Commissioners. This ordinance is required by the Ohio Revised Code as enacted by the General Assembly of the State of Ohio.  Upon approval by City Council, a certified copy of this ordinance will be provided to the Franklin County Commissioners in conjunction with an annexation petition.

 

This ordinance is filed as emergency legislation in order to facilitate the design and construction schedule for this new facility.  

 

 FISCAL IMPACT:  This ordinance has no direct fiscal impact.  While the provision of the city services will represent a cost to the city, this annexation will also create revenue through the employment taking place on the site.

 

Title

To authorize the Director of Development to file a municipal petition for the annexation of 11.3± acres within Franklin Township as provided in section 709.16 of the Ohio Revised Code and to provide for acceptance of the property by the City of Columbus upon approval of the petition by the Board of Franklin County Commissioners; and to declare an emergency.

 

Body

WHEREAS, Franklin County is seeking to construct a new County Forensic Center; and

 

WHEREAS, the site is not currently within the City of Columbus; and

 

WHEREAS, redevelopment of the site will be facilitated by its annexation into Columbus; and

 

WHEREAS, section 709.16 of the Ohio Revised Code allows for municipalities to file annexation petitions of territory owned by the municipality, a county or the state; and 

 

WHEREAS, the City is able to provide municipal services to this site; and

 

WHEREAS, authorization by City Council is necessary for submission of a municipal annexation petition to the Board of Franklin County Commissioners; and

 

WHEREAS, upon receipt of the petition by the City to annex the site, the Board of Franklin County Commissioners must take action within 30 days; and

 

WHEREAS,  whereas the City of Columbus desires to add the referenced territory described in detail in section 1 below to its boundaries if the petition is approved by the Board of Franklin County Commissioners; and

 

WHEREAS,  an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to present this ordinance to the Franklin County Board of  Commissioners in accordance with the Ohio Revised Code to facilitate the design and construction schedule for the new  Franklin County Forensic Center new facility; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Director of Development is authorized to file a municipal petition for annexation as outlined in section 709.16 of the Ohio Revised Code of 11.3+/- acres in Franklin Township, Franklin County,  located on Reynoldsburg-New Albany Road and associated with the Blacklick Creek Sanitary Interceptor Sewer project and described more specifically as follows:

Situated in the State of Ohio, County of Franklin, Township of Franklin, in Virginia Military Survey Number 717, being all of that 11.289 acre tract of land conveyed to Commissioners of Franklin County by deed of record in Instrument Number 201304080057014 (all references are to the records of the Recorder's Office, Franklin County, Ohio) and more particularly bounded and described as follows:

BEGINNING at the southeasterly corner of Lot 10 of the subdivision entitled "Josephine B. Cheney Addition", of record in Plat Book 10, Page 392, in the northerly right of way line of Frank Road;

Thence northerly, with the easterly line of said subdivision and the easterly line of that tract conveyed to Donald F. and Deborah K. Morris by deed of record in Official Record 886117, a distance of 788'± to the south westerly corner of the subdivision entitled "Autumn Village Section III", of record in Plat Book 81, Page 65, in the existing City of Columbus corporation line as established by Ordinance Number 371-72, recorded in Miscellaneous Volume 155, Page 566;

Thence easterly, with the southerly line of said "Autumn Village Section III" and said existing corporation line, a distance of 628'± to the northwesterly corner of the subdivision entitled "Westbrook Subdivision", of record in Plat Book 26, Page 23;

Thence southerly, with the westerly line of said "Westbrook Subdivision" and the westerly line of that tract conveyed to Columbus and Southern Ohio Electric Company by deed of record in Deed Book 1679, Page 414, a distance of 786± to a point in the northerly right of way line of said Frank Road;

Thence westerly, with said northerly right of way line, a distance of 629'± feet to the POINT OF Beginning, containing 11.3± acres of land, more or less.

Section 2. That the City of Columbus will accept the territory described in section 1 upon approval of the petition by the Board of Franklin County Commissioners.

 

Section 3. That the City Clerk is hereby authorized and directed to perform such acts as set forth in R.C. 709.06, or as otherwise required by law, in order to ensure the proper recording of the annexation.

 

Section 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
