BACKGROUND:
This legislation will authorize the amendment of Ord. No.#: 2008-2018 (Auditor's Certificate: ACPO003361), passed on July 23, 2018. There was an error on Ord. No. 2008-2018 between the named vendor, federal identification number (F.I.D.) and the DAX vendor account number which is being corrected via this ordinance. Ordinance No. 2008-2018 incorrectly authorized the wrong vendor: Key Tracer Systems, Inc. (FID#: 98-0620985; DAX vendor account no. #011017) in the legislation. The correct vendor: Real Time Networks, Inc. dba Key Tracer Systems, Inc. (FID#: 98-1220062; DAX vendor account no. #020066) should be the authorized vendor for the provision of the software maintenance support and extended warranty services for this contract.
After the passage of Ord. No. 2008-2018 and during the contract/purchase order process, the vendor Real Time Networks, Inc. dba Key Tracer Systems, Inc. notified the City of Columbus, Department of Technology that the company had undergone a corporate rebranding to create a new corporate identity. Due to this rebranding name and federal identification number change it required an ordinance to correctly apply the auditor certificate (ACPO003361) previously authorized by ordinance: 2008-2018 to reflect the correct vendor name in order to utilize the funds.
This ordinance requests approval to continue services provided by Real Time Networks, Inc. dba Key Tracer Systems, Inc., in accordance with sole source procurement provisions of Chapter 329 of Columbus City Code. It has been determined that Real Time Networks, Inc., dba Key Tracer Systems, Inc., is the sole source of software maintenance support and extended warranty services and does not utilize re-sellers for this purpose.
EMERGENCY:
Emergency action is requested to immediately amend Ord. No. 2008-2018 (ACPO003361) and to expedite authorization of the contract/ purchase order from the correct supplier, Real Time Networks, Inc. dba Key Tracer Systems, Inc. (98-1220062; DAX Acct. # 020066), at the prices proposed.

There is no additional fiscal impact or funding associated with this legislation.

Title
To amend Ordinance No. 2008-2018 to correct the vendor name from Key Tracer Systems, Inc. to Real Time Networks, Inc., dba Key Tracer Systems, Inc., as the authorized vendor for the provision of the software maintenance support and extended warranty services; to authorize the Auditor Certificate associated with the ordinance to be utilized with Real Time Networks, Inc., dba Key Tracer Systems, Inc., in accordance with sole source procurement provisions of the Columbus City Code; and to declare an emergency. WHEREAS, it is necessary to amend Ord. No.#: 2008-2018 (Auditor's Certificate: ACPO003361), passed on July 23, 2018 to correct an error between the named vendor, F.I.D. number, and the DAX vendor account number that is being corrected via this ordinance. Ord. No. 2008-2018 incorrectly authorized the wrong vendor: Key Tracer Systems, Inc (FID#: 98-0620985; DAX vendor account no. #011017) in the legislation. The correct vendor: Real Time Networks, Inc. dba Key Tracer Systems, Inc. (FID#: 98-1220062; DAX vendor account no. #020066) should be the authorized vendor for the provision of the software maintenance support and extended warranty services. This ordinance will allow for Auditor Certificate No. ACPO003361 to be utilized with the correct vendor Real Time Networks, Inc. dba Key Tracer Systems, Inc.; and
WHEREAS, after the passage of Ord. No. 2008-2018 and during the contract/purchase order process, the vendor Real Time Networks, Inc. DBA Key Tracer Systems, Inc. notified the City of Columbus, Department of Technology that the company had undergone a corporate rebranding to create a new corporate identity. WHEREAS, no additional funding is necessary or required via this ordinance; and
WHEREAS, the services provided by Real Time Networks, Inc. dba Key Tracer Systems, Inc., are in accordance with the sole source procurement provisions of Section 329 of Columbus City Code. It has been determined that Real Time Networks, Inc. dba Key Tracer Systems, Inc. is the sole source of software maintenance support and extended warranty services and does not utilize re-sellers for this purpose; and
WHEREAS, an emergency exists in the usual daily operations of the Department of Technology in that it is immediately necessary to authorize this amendment of Ord. No.#: 2008-2018 (Auditor's Certificate: ACPO003361), passed on July 23, 2018 to correct the vendor name, federal identification number and DAX vendor account number that is being corrected via this ordinance, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1: That Ord. No.#: 2008-2018 (ACPO003361), passed on July 23, 2018, is hereby amended to correct and update the vendor providing the named services from Key Tracer Systems, Inc. (FID#: 98-0620985) to Real Time Networks, Inc., dba Key Tracer Systems, Inc., (FID#: 98-1220062; DAX vendor account no. #020066) for the provision of software maintenance support and extended warranty services.
SECTION 2: That Auditor Certificate No. ACPO003361 is authorized to be utilized with Real Time Networks, Inc. dba Key Tracer Systems, Inc. (DAX vendor account no. # 020066). There is no additional funding associated with this ordinance.
SECTION 3: That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 4: That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5: That this contract is being entered into pursuant to the sole source provisions of the Columbus City Code Chapter 329.
SECTION 6: That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
