Explanation

1.  BACKGROUND

This legislation authorizes a bidding waiver for the Director of Public Service to enter into professional services contracts with EMH&T (Evans, Mechwart, Hambleton & Tilton) in the amount of up to $49,000.00 for the Nationwide Blvd and Hocking Street project.

 

This project is under construction with the work effort currently minimal due to the winter season.  Construction plans need to be updated prior to commencement of work when the weather improves to accommodate a wider section of roadway along Nationwide Blvd due to the introduction of a development project in the area of the construction known as Confluence Village.  Updated plans are needed by the construction contractor in five weeks to keep construction on schedule.  Due to the tight timeframe to produce the updated plans, there is not enough time to conduct a competitive event to select a professional services provider and wait for them to familiarize themselves with the project and the existing design.  EMH&T is the designer of record.  A bidding waiver is requested to award a contract to EMH&T to update the existing plans. 

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against EMH&T.

 

2.  CONTRACT COMPLIANCE

EMH&T’s contract compliance number is CC004214 and expires 01/19/2020.

 

3.  FISCAL IMPACT

Funding for this contract is available within the Streets and Highways Bond Fund, Fund 7704, Project P530103-100052 (Arterial Street Rehabilitation - Hamilton Road-I-70 to Refugee Road)An amendment to the 2018 Capital Improvement Budget is required to establish sufficient budget authority for the project, and a transfer of cash is necessary to provide sufficient cash for the project.

 

4.  EMERGENCY DESIGNATION

Emergency action is requested to allow construction plans to be updated and ready for use when the weather allows construction to resume.

To amend the 2018 Capital Improvement Budget; to authorize the transfer of funds within the Streets and Highways Bond Fund; to waive the formal bidding requirements of Columbus City Code; to authorize the Director of Public Service to enter into a professional services contract with EMH&T for the Nationwide Blvd and Hocking Street project; to authorize the expenditure of up to $49,000.00 from the Streets and Highways Bond Fund to pay for this contract; and to declare an emergency.  ($49,000.00)

 

Body

WHEREAS, plans were developed and construction commenced for the Nationwide Blvd and Hocking Street project; and

 

WHEREAS, construction activity on the project is currently minimal due to winter weather and awaiting the arrival of warmer weather; and

 

WHEREAS, there is a need to enter into a professional services contract to provide for updated construction plans to accommodate a wider section of roadway along Nationwide Blvd due to the introduction of a development project known as Confluence Village; and

 

WHEREAS, EMH&T provided the design services for the original construction plans; and

 

WHEREAS, there is not enough time to conduct a competitive event to select a professional services provider to update the plans and wait for them to familiarize themselves with the project and the existing design before construction season resumes; and

 

WHEREAS, it is necessary to waive the competitive bidding requirements of Columbus City Code and enter into a contract with EMH&T for the provision of professional engineering consulting services in the amount of up to $49,000.00 to update the project design and produce construction plans; and

 

WHEREAS, it is necessary to authorize an amendment to the 2018 Capital Improvement Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and

 

WHEREAS, it is necessary to authorize a transfer of funds within Fund 7704, the Streets and Highways Bond Fund, to establish sufficient cash to pay for the project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director of Public Service to enter into contract with EMH&T in order to allow construction plans to be updated and ready for use when the weather allows construction to resume, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2018 Capital Improvements Budget authorized by Ordinance 1010-2018 be amended as follows to establish sufficient authority for this project:

SECTION 2.  That the transfer of $49,000.00, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5912 (Design and Construction), Project P530103-100052 (Arterial Street Rehabilitation - Hamilton Road-I-70 to Refugee Road), Object Class 06 (Capital Outlay) to Dept-Div 5912 (Design and Construction), Project P531005-100000 (Nationwide Blvd and Hocking Street), Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That City Council finds that it is in the best interest of the City of Columbus to waive the formal competitive bidding requirements of City Code Chapter 329.

 

SECTION 4.  That the Director of Public Service be, and hereby is, authorized to enter into a professional services contract with EMH&T at 5500 New Albany Road, Columbus, Ohio, 43054, for the Nationwide Blvd and Hocking Street project in an amount up to $49,000.00.

 

SECTION 5.  That the expenditure of $49,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5912 (Design and Construction), Project P531005-100000 (Nationwide Blvd and Hocking Street), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 6.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 9.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
