Explanation

 

1.   BACKGROUND:  This legislation authorizes the Director of Public Utilities to modify (Mod #1) an existing professional engineering agreement with CHA Consulting, Inc. for the Moler Street Overflow Interceptor Sewer project, CIP 650763-100000. This project will develop, design, and provide engineering services during construction for the City’s Moler Street Overflow Intercepting Sewer and Moler Street Storm Sewer Relocation Project. The overflow interceptor sewer will convey Moler street regulator combined sewer overflows and the south side interceptor sewer wet weather flows directly into the OARS tunnel thru Shaft 3. The storm sewer will be relocated north to provide a discharge location for future inflow redirection in the Moler and Markison tributary areas.

 

Major scope changes include disconnecting the Moler Street Storm sewer from the Moler Street regulator main storm overflow channel.  The Moler Street storm sewer will be redirected north with a new discharge to the Scioto River west of Gates Street. Additional modifications to the Moler Street regulator chamber are required. The disconnection/redirection of Moler Street storm sewer provides future inflow redirection to mitigate Water- In-Basement (WIB) occurrences within the Moler Street combined sewer area and northern portion of the Markison Avenue combined sewer area.  Modifications to Moler Street regulator chamber allow capture of its combined sewer overflow and direct conveyance into OARS Shaft 3 using existing storm sewer overflow pipes.

 

Services will include: field activities to obtain design data, development of a design report, prepare detailed plans and specifications, easements, permits, bid documents, public outreach & coordination activities and provide engineering services during construction. 1.2                     Reasons additional goods/services could not be foreseen: 

The modified contract includes services to develop, design, and provide engineering services during construction for the City’s Moler Street Overflow Intercepting Sewer and Moler Street Storm Sewer Relocation Project. The Moler street regulator combined sewer overflows and south side interceptor sewer wet weather flow will be conveyed directly into OARS tunnel thru Shaft 3 using the existing storm sewer pipe and a small section of new sewer. The Moler street storm sewer will be relocated north to provide a discharge location for future inflow redirection in the Moler and Markison tributary areas. 1.3                     Reasons other procurement processes are not used: 

The Moler Street Overflow Intercepting Sewer and construction must be completed by December 31, 2022 per the Ohio Environmental Protection Agency consent orders and City of Columbus Integrated Plan and 2015 WWMP Update Report. To complete the Moler Street Overflow Intercepting Sewer on schedule, the contract modification cannot be bid out.

 

1.4                     How cost of modification was determined:

The cost was determined by negotiations between CHA Consulting, Inc. and DOSD. (Note: for additional information, please see the attached Director’s Information Sheet.)

2.                     Project timeline: This modification is expected to be completed by December of 2022.

 

3.  EMERGENCY DESIGNATION: Is not requested at this time.

5.                     ECONOMIC IMPACT: This project was identified in the City of Columbus Integrated Plan and 2015 WWMP Update Report which was developed with input from various stakeholders and submitted to Ohio EPA. This project will mitigate combined sewer overflows into the Scioto River from the Moler street combined sewer regulator and provide wet weather relief of the South Side interceptor Sewer. This project will design and construct a municipal separate storm sewer outfall to the Scioto River. Short term economic impacts will be in terms of the prime and six sub consultants design work on the project.

 

6.                     FISCAL IMPACT: This legislation authorizes the transfer within and the expenditure of up to $ 1,102,239.19 from the Sanitary Sewer General Obligation Bond Fund, Fund 6109; and amends the 2018 Capital Improvements Budget.

WHEREAS, it is necessary to modify (Mod #1) an existing engineering agreement with CHA Consulting, Inc. for the Moler Street Overflow Interceptor Sewer Project, CIP 650763-100000; and

 

WHEREAS, this modification will develop, design, and provide engineering services during construction for the City’s Moler street overflow intercepting sewer and Moler street storm sewer relocation project; and

 

WHEREAS, the original contract number, PO032542 was authorized by Ordinance No. 2062-2016, passed by the Columbus City Council on September 19, 2016; executed by the Director on October 27, 2016, approved by the City Attorney on October 28, 2016; certified by the City Auditor October 31, 2016; and

 

WHEREAS, it is necessary to authorize the transfer and the expenditure of up to $1,102,239.19 within the Sanitary Sewer System General Obligation Bond Fund, Fund 6109; and

 

WHEREAS, it is necessary to authorize an amendment to the 2018 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditures; and

 

WHEREAS,  it has become necessary in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, to authorize the Director of Public Utilities to modify an existing professional engineering services agreement with CHA Consulting, Inc. for the Moler Street Overflow Intercepting Sewer Project, CIP 650763-100000 at the earliest practical date for the preservation of the public health and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.   That the Director of Public Utilities is hereby authorized to modify (Mod #1) an existing professional engineering services agreement with CHA Consulting, Inc., 471 East Broad Street, Suite 2010, Columbus, Ohio 43215; for the Moler Street Overflow Intercepting Sewer Project in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.

 

SECTION 2. That the City Auditor is hereby authorized and directed to transfer up to $1,102,239.19 from the Sanitary Sewer General Obligation Bond Fund 6109 per the account codes in the attachment to this ordinance.

 

Section 3. That the 2018 Capital Improvements Budget is hereby amended, in Fund 6109, Sanitary Sewer G.O. Bonds Fund as follows:

SECTION 4. That the Director is hereby authorized to expend up to $1,102,239.19 in the following manner: Sanitary Sewer G.O. Bond Fund 6109 per the attached DAX financial form.

 

SECTION 5. That the said engineering company, CHA Consulting, Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.

 

SECTION 6. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.

 

SECTION 7. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 8. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 9. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
