Explanation

 

This ordinance authorizes the Director of the Recreation and Parks Department to enter into contract with Mark Haynes Construction, Inc. for the Franklin Park Cascades and Ponds Restoration project and for the expenditure of $2,200,000.00 from the Voted Recreation and Parks Bond Fund.

 

Background:  The Ponds and the associated Cascades were constructed for Ameriflora in 1991.  The Phase I construction project addressed the existing pump system which had not been performing as designed since 2016.  Phase I included the removal of the underground, non-operational pumps in the park and replaced them with a new above ground system with variable speed drives and turbine pumps enclosed in a pump house.  This phase was critical to returning flow to the cascades. 

 

This project (Phase II) aims to address both ponds and the associated cascades which have numerous voids and deteriorating base and edges. 

 

The upper pond will be deepened from an overall 3’ depth to 10’ at the deepest point with gradual slopes.  This deepening will help to promote a healthier system overall.  The pond bottom will be relined and all edge conditions will be replaced, repaired, and cleaned up as necessary.

 

The lower pond will be drained to allow for all the existing muck to be removed.  Deepening of the lower pond alternate was not accepted due to budgetary limitations.  All edge conditions will be cleaned up. 

 

The cascades between the two ponds will be addressed to alleviate leaking and promote a sustainable system for the future.  The existing waterfall features will be cleaned, sealed, and restored.  The connecting features between the falls will be reconstructed to mimic natural and native stream conditions and planted with native plant species representative of the different ecosystems created.

 

Alternate 1 was accepted which will address the 3 existing bridges within the cascade area.  All decking and railing will be replaced.  Alternate 2 was accepted which will create a natural wetland filtration system at the base of the cascades prior to the lower pond.  This addition will promote a healthier system overall.

 

ODNR has committed to restocking both ponds following the construction.

 

Bids were advertised through Vendor Services, in accordance with City Code Section 329, on February 8, 2019 and were received by the Recreation and Parks Department on February 26, 2019.  Bids were received from the following companies:

After reviewing the proposals that were submitted, it was determine that Mark Haynes Construction, Inc. was the lowest and most responsive bidder.

 

Mark Haynes Construction, Inc. and all proposed subcontractors have met code requirements with respect to prequalification, pursuant to relevant sections of Columbus City Code Chapter 329.

Emergency Justification: An emergency is being requested in order to provide ample time to procure the extensive plant material specified for the project in time for the fall planting window.

 

Benefits to the Public: Project aims to renovate and maintain unique and sustainable amenities for public enjoyment and to enhance educational opportunities.

 

Community Input/Issues: Public requests to reactivate the cascades and water features in the park that have not had water flow since spring 2016.

Fiscal Impact: $2,200,000.00 is budgeted and available in the Recreation and Parks Voted Bond Fund 7702 to meet the financial obligations of this contract.

To authorize the Director of the Recreation and Parks Department to enter into a contract with Mark Haynes Construction, Inc. for the Franklin Park Cascades and Ponds Restoration project; to authorize the expenditure of $2,200,000.00 from the Recreation and Parks Voted Bond Fund; and to declare an emergency. ($2,200,000.00)

 

Body

 

WHEREAS, it is necessary to authorize the Director of the Recreation and Parks Department to enter into contract with Mark Haynes Construction, Inc. for the Franklin Park Cascades and Ponds Restoration project;

 

WHEREAS, it is necessary to authorize the expenditure of $2,200,000.00 from the Recreation and Parks Voted Bond Fund 7702; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Recreation and Parks in that it is immediately necessary to authorize the Director to enter into contract with Mark Haynes Construction, Inc., in order to provide ample time to procure the extensive plant material specified for the project in time for the fall planting window, for the preservation of the public health, safety and welfare; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks is hereby authorized to enter into contract with Mark Haynes Construction, Inc. for the Franklin Park Cascades and Ponds Restoration project. 

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the expenditure of $2,200,000.00 or so much thereof as may be necessary, be and is hereby authorized from the Recreation and Parks Recreation and Parks Voted Bond Fund 7702 per the accounting codes in the attachment to this ordinance.

 

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
