Explanation
1. BACKGROUND
The Department of Public Service is responsible for snow and ice control on the City’s roadway system. In removing snow and ice, the department uses a variety of deicing chemicals. The department has been notified by our vendor that one of the primary chemicals used for deicing will not be available for the 2019-2020 Winter season. The Department has determined it is in the best interest of the city to utilize the Ohio Department of Transportation (ODOT) deicing chemical contracts that are available to the city.
This ordinance authorizes the Director of Finance and Management, on behalf of the Department of Public Service, to establish purchase orders, enter into contracts, create purchase agreements, and associate all general budget reservations resulting from this ordinance with the appropriate purchase agreement necessary from existing and future ODOT chemical deicing contracts to obtain deicing chemicals for the 2019-2020 Winter season.
This ordinance seeks approval for the Finance and Management Director on behalf of the Department of Public Service to use ODOT’s contract number 124-19. ODOT 124-19 includeds the following five (5) vendors: Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC. The Division of Infrastructure Management has a need for the following deicing chemicals from the above five vendors, which are on the current ODOT deicing chemical contract:
Chloride Solutions LLC: GEOMELT 55 Liquid Organic Accelerator, GEOMELT S7 Anti-icing/Deicing Fluid
EnviroTech Services Inc.: AMP, Meltdown Apex-C, SOS-C Inhibited
Great Lakes Cloride Inc.: Calcium Chloride with BOOST
K-Tech Specialty Coatings Inc.: BEET HEET Concentrate, BEET HEET Severe, XO-Melt2
Nature’s Own Source LLC: AquaSalina+ Liquid Enhanced Brine Deicer, AQ+IceBite Liquid Enhanced Brine Deicer
The Director of Finance and Management is hereby authorized to associate all General Budget Reservations resulting from this ordinance with the appropriate ODOT contracts for the listed deicing chemicals for the Division of Infrastructure Management from established, pending and future ODOT de-icing contracts.
2. CONTRACT COMPLIANCE
ODOT 124-19 (Pacific Northwest Snow Fighters (PNS) Approved Liquid De-Icer & Corrosion Inhibited Calcium Chloride) contract is effective from 11/1/18 through 10/31/19.
3. FISCAL IMPACT
This is a budgeted expense within the Municipal Motor Vehicle Tax Fund (Fund 2266).
4. EMERGENCY DESIGNATION
The department requests emergency action to ensure the timely availability of deicing chemicals for snow and ice control on the City’s roadway systems.

To authorize the Director of Finance and Management, on behalf of the Department of Public Service, Division of Infrastructure Management, to use Ohio Department of Transportation contracts, and to issue purchase orders with Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC for deicing chemicals for snow and ice control on the roadways of Columbus; to authorize the Director of Finance and Management to associate all General Budget reservations resulting from this ordinance with the appropriate ODOT contract for deicing chemicals, to authorize the expenditure of $200,000.00 from the Municipal Motor Vehicle Tax Fund; and to declare an emergency. Body
WHEREAS, the Department of Public Service, Division of Infrastructure Management needs to purchase deicing chemicals for snow and ice control on the roadways of Columbus; and
WHEREAS, ODOT opened formal bids on October 23, 2018, for deicing chemicals; and
WHEREAS, ODOT awarded the deicing contract to Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC; and
WHEREAS, it is necessary to authorize the Director of Finance and Management to associate all General Budget Reservations resulting from this ordinance with the appropriate ODOT deicing chemical purchase agreement; and
WHEREAS, funds are available in the Municipal Motor Vehicle Tax Fund (Fund 2266) for this expense; and
WHEREAS, it has become necessary in the usual daily operation in the Department of Public Service to authorize the Director of Finance and Management to enter into contracts, create purchase agreements, establish purchase orders, and associate all general budget reservations resulting from this ordinance with the appropriate purchase agreement necessary from existing and future ODOT chemical deicing contracts to obtain deicing chemicals for the 2019-2020 Winter season, and authorize the expenditure with Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC in accordance with the terms, conditions, and specifications of ODOT Invitation Number: 124-19 on file; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Infrastructure Management, in that it is immediately necessary to authorize the Finance and Management Director to enter into contract with Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC so that the City prepare for the 2019-2020 Winter season as quickly as possible, thereby preserving the public health, peace, property, safety, and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management on behalf of the Department of Public Service be and is hereby authorized to establish contracts, purchase agreements and create purchase orders utilitizing ODOT contract 124-17 with Chloride Solutions, LLC, EnviroTech Services, Inc., Great Lakes Cloride, Inc., K-Tech Specialty Coatings, Inc., and Nature’s Own Source, LLC for the purchase of deicing chemicals.
SECTION 2. That the expenditure of $200,000.00 or as much thereof as may be needed, is hereby authorized in Fund 2266, (Municipal Motor Vehicle Tax Fund), Dept-Div 5911 (Division of Infrastructure Management) in Object Class 02 (Materials & Supplies) per the accounting codes in the attachment to this ordinance.
SECTION 3. That the Director of Finance and Management be and is hereby authorized to associate all General Budget Reservations resulting from this ordinance with the appropriate ODOT deicing chemical Purchase Agreements for the purchase of deicing chemicals for the Division of Infrastructure Management for the 2019/2020 Winter Season.
SECTION 4. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
