BACKGROUND: The City of Columbus, Department of Development, Land Redevelopment Division owns one (1) parcel of real property that the Department of Public Service, Division of Design and Construction needs for project 531012-100000 Roadway Improvements - Medina Ave from Hudson to Briarwood to construct a permanent Best Management Practice to meet storm water treatment requirements and reimburse the Land Redevelopment Division. The Department of Public Utilities, Division of Sewerage and Drainage will assume responsibility for the maintenance of this property after construction is complete.

FISCAL IMPACT: The Department of Public Service, Division of Design and Construction will pay the Department of Development, Land Redevelopment Division a total of $2,270.00 for the one parcel.
EMERGENCY JUSTIFICATION: Emergency Legislation is requested to expedite the transfer in order to reduce Land Bank maintenance costs.

To authorize the Director of the Department of Development to transfer the control and maintenance responsibilities of one parcel of real property (010-074595, 1338 Republic Ave., Reimbursement $2,270.00) held in the Land Redevelopment Division, Land Bank Program from the Department of Development to the Department of Public Utilities, Division of Sewerage and Drainage to facilitate the project 531012-100000 Roadway Improvements - Medina Ave from Hudson to Briarwood; and to declare an emergency.

WHEREAS, Parcel Number: 010-074595 (1338 Republic Ave.) is currently controlled by the Land Redevelopment Division; and
WHEREAS, the Department of Public Service, Division of Design and Construction wishes to acquire this parcels from the Department of Development, Land Redevelopment Division to facilitate 531012-100000 Roadway Improvements - Medina Ave from Hudson to Briarwood project; and
WHEREAS, the Department of Development, Land Redevelopment Office no longer needs this parcel for redevelopment but the City of Columbus will retain ownership; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development, Land Redevelopment Office in that it is immediately necessary to expedite the control and mainenance responsibilities in order to reduce Land Bank maintenance costs, all for the immediate preservation of the public health, peace, property, safety and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Parcel Number: 010-074595 (1338 Republic Ave.) is no longer needed by the City’s Land Redevelopment Division for redevelopment.
SECTION 2. That the control and maintenance responsibilities of this asset shall be transferred from the Department of Development, Land Redevelopment to the Department of Public Utilities, Division of Sewerage and Drainage.
Section 3. That this ordinance, for the reasons stated in the preamble of this ordinance, which are made of part of this ordinance and fully incorporated for reference as if rewritten, is declared to be an emergency measure and shall take effect and be in force from and after this ordinance’s adoption and approval by the Mayor or ten (10) days after its adoption if the Mayor neither approves nor vetoes this ordinance.
