Explanation

 

Background: The City owns real property located at 6000 Harriott Drive, Powell, Ohio 43065 {Delaware County Tax Parcel 600-423-01-009-000} (“Property”), which is managed by the Finance and Management Department (“Finance”).  The Village of Shawnee Hills (“Shawnee”) contacted the City requesting that the City grant them a 0.056 acre drainage easement across City property in order to construct a riprap channel for public storm water drainage.  The City’s Departments of Finance and Management, Recreation and Parks, and Public Utilities reviewed the easement request and determined that the Easement Area requested by Shawnee should be granted and that the City should charge Shawnee Six Thousand and 00/100 U.S. Dollars ($6,000.00).  Therefore, the following legislation authorizes the City’s Director of the Department of Finance and Management, with approval from the Directors of the Recreation and Parks Department and the Department of Public Utilities, to execute those documents as approved by the Columbus City Attorney, Real Estate Division, to grant the easement to Shawnee so that they may construct a riprap channel for public storm water drainage (“Improvement”). Once constructed Shawnee will, at its sole cost and expense, maintain the easement area and any improvements according to the City’s specifications.

 

Fiscal Impact: The City’s receipt of the Six Thousand and 00/100 U.S. Dollars ($6,000) from Shawnee will be deposited within the Water Operating Fund, Fund 6000.

 

Emergency Justification: Emergency action is requested to not delay the start of construction for the Project, which will preserve the public peace, health, property, safety, and welfare.

Body

 

WHEREAS, the City desires to grant the Village of Shawnee Hills (‘Shawnee”) a 0.056 acre, more or less, Perpetual Drainage Easement in, on, over, under, across, and through a portion of City-owned real property located along the Scioto River in the vicinity of Harriott Drive Powell, Ohio 43065 {Delaware County Tax Parcel 600-423-01-009-000} (“Easement Area”); and

 

WHEREAS, Shawnee will use the Easement Area, which is generally described and depicted in the Two (2) page attachment, which is fully incorporated for reference as if rewritten, for construction and grading to install a riprap channel for the drainage of public storm water (“Improvement”); and

WHEREAS, the Improvement and Easement Area will be installed and maintained by Shawnee at their sole cost and expense; and

 

WHEREAS, the City’s Department of Finance and Management determined that the Easement Areas requested by Shawnee for storm water drainage should be granted at a price of Six Thousand and 00/100 U.S. Dollars ($6,000.00); and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to authorize the Director to execute those documents necessary for the granting of these easements to not delay the construction of the drainage improvement, which will preserve the public peace, health, property, safety, and welfare; and now, therefore:

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Finance and Management, with approval from the Directors of the Recreation and Parks Department and the Department of Public Utilities, is authorized to execute those documents, as approved by the City Attorney’s Office, Real Estate Division, necessary to grant the Village of Shawnee Hills (‘Shawnee”) a 0.056 acre, more or less, Perpetual Drainage Easement in, on, over, under, across, and through a portion of City-owned real property located along the Scioto River in the vicinity of Harriott Drive Powell, Ohio 43065 {Delaware County Tax Parcel 600-423-01-009-000} (“Easement Area”) which is generally described and depicted in the Two (2) page attachment, which is fully incorporated for reference as if rewritten, for construction and maintenance of a riprap channel for public storm water drainage (“Improvement”).

 

SECTION 2. That Shawnee shall, at its sole cost and expense, construct the Improvement and Maintain the Easement area according to City specifications.

 

SECTION 3. That the City Attorney’s Office, Real Estate Division is required to approve all instrument(s), associated with this ordinance. 

SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
