Explanation

BACKGROUND:  This legislation authorizes the Finance and Management Director to enter into a contract on behalf of the Office of Construction Management with RW Setterlin Building Company for the demolition and replacement of a new Public Service Department Roberts Road Outpost, 4380 Currency Drive.  This contract consists of the demolition of the existing structures and the construction of a new administration building. Also to be constructed will be vehicle storage (both enclosed and open), truck wash bay, and a pre-wash area.  This  contract  will  provide  for  the  demolition  of  the  existing  buildings and  the  construction  of  a  new  facility  at  4380 Currency  Drive  for  the  purpose  of  providing  a  fully  operational outpost.

 

Formal bids were solicited and the City received four (4) bids (0 FBE, 0 MBE) on October 2, 2019 as follows:

After evaluation of the bids, it was determined that the lowest non-local bid was submitted by Thomas & Marker Construction in the amount of $11,218,010.50.   The local bidder, RW Setterlin Building Company's bid was $11,248,762.50.  In accordance with Columbus City Code Section 329.212, if a local bidder is within 1% of the non-local's bid, the local bidder may be awarded the contract if they agree to meet the lowest bid price and to provide a revised bid to demonstrate the same. RW Setterlin Building Company, elected to revise their bid to $11,156,970.50.  Therefore, the Office of Construction Management recommends the bid award be made to RW Setterlin Building Company, as the lowest, responsive, responsible, and best bidder, in accordance with Columbus City Code Section 329.212.

RW Setterlin Building Company  Contract Compliance No. 31-0836188, expiration date January 2, 2021.

 

Emergency action is requested to meet the time constraint and the compressed construction schedule.

 

Fiscal Impact:  This legislation authorizes an appropriation and expenditure of $11,156,970.50 from the Street and Highways Bond Fund for demolition and construction services related to the demolition and replacement of a new Roberts Road Outpost at 4380 Currency Drive.  These funds were budgeted within the Street and Highways Bond Fund.

To amend the 2019 Capital Improvement Budget; to authorize the Director of Finance and Management to enter into a contract on behalf of the Office of Construction Management with RW Setterlin Building Company for the demolition and replacement of the Roberts Road Outpost for the Public Service Department; to authorize the transfer of $11,156,970.50 within the Street and Highways Bond Fund; to authorize the expenditure of $11,156,970.50 from the Street and Highways Bond Fund; and to declare an emergency. Body

 

WHEREAS, it is necessary to amend the 2019 Capital Improvement Budget and to authorize transfers between projects within the Street and Highways Bond Fund; and

 

WHEREAS, the Finance and Management Department, Office of Construction Management, desires to enter into a contract for the demolition and replacement of the Roberts Road Outpost, 4380 Currency Drive; and

 

WHEREAS, formal bids were solicited by the Office of Construction Management and the City received four bids on October 2, 2019; and

 

WHEREAS, RW Setterlin Building Company was deemed the lowest, responsive, responsible and best bidder in accordance with Section 329.212 of the City Code; and

 

WHEREAS, it is necessary to authorize the expenditure of $11,156,970.50 from the Street and Highways Bond Fund; and

 

WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Director of Finance and Management to enter into a contract with RW Setterlin Building Company for demolition and replacement of the Public Service Department Roberts Road Outpost due to time constraints and to meet the compressed construction schedule, thereby preserving the public health, peace, property, safety, and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Finance and Management Director is hereby authorized to enter into a contract on behalf of the Office of Construction Management with RW Setterlin Building Company for demolition and replacement of the Public Service Department Roberts Road Outpost located at 4380 Currency Drive.

SECTION 2. That the 2019 Capital Improvements Budget authorized by ordinance 1326-2019 be amended as follows to establish  sufficient authority for this project:

SECTION 3.  That the transfer of $515,588.90 in cash and appropriation, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5912 (Design and Construction), Project P530161-100148 (Roadway Improvements - Lazelle Road Phase C), Object Class 06 (Capital Outlay) to Dept-Div 4550 (Construction Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 4.  That the transfer of $32,206.17 in cash and appropriation, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5913 (Design and Construction), Project P530161-100148 (Roadway Improvements - Lazelle Road Phase C), Object Class 06 (Capital Outlay) to Dept-Div 4550 (Construction Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 5.  That the transfer of $10,000,000.00 of appropriation is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5912 (Design and Construction), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) to Dept-Div 4550 (Construction Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 6.  That the transfer of $609,175.43 of appropriation is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5911 (Infrastructure Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) to Dept-Div 4550 (Construction Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 7.  That the expenditure of $11,156,970.50, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 4550( Construction Management), Project P530704-100000 (Facilities - New Roberts Rd. Outpost), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 8That the monies in the foregoing sections shall be paid upon order of the Director of Finance and Management, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 9.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 10.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 11That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 12.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
