Title: To amend Ordinance 3503-2018 to reflect the deferment of planned improvements to the stretch of Sawmill Road between Saltergate Drive and Summit View Road, which will be completed on behalf of the City of Dublin as part of the Resurfacing - 2020 projects; and to declare an emergency. Explanation

1.  BACKGROUND

This legislation seeks to amend Ordinance 3503-2018 to reflect: 1) the completion of certain infrastructure improvements benefiting the City of Dublin has been deferred until the 2020 construction season and 2) the estimated construction and inspection costs to be borne by the City of Dublin relative to said improvements.

Ordinance 3503-2018 authorized the Director of Public Service to enter into agreements with and to accept funding from the City of Dublin relative to Resurfacing - 2019 Project 1 to support improving the stretch of Sawmill Road between Saltergate Drive and Summit View Road, located within the limits of the City of Dublin. However, the parties since have agreed the aforementioned work shall be performed as part of the annual resurfacing program in 2020 due to changing budgetary and service demands.  It is currently expected that the work will be done as part of Resurfacing 2020 Project 1.  However, it may be necessary to include the work as part of another of the 2020 resurfacing projects. 

2.  EMERGENCY DESIGNATION

Emergency action is requested to facilitate the execution of agreements with the City of Dublin and the acceptance and expenditure of requisite construction funding as soon as reasonably practicable so as to prevent delays in planned procurement and construction activities.

WHEREAS, Ordinance 3503-2018 authorized the Director of Public Service to enter into agreements with and to accept funding from the City of Dublin relative to Resurfacing - 2019 Project 1 to support improving the stretch of Sawmill Road between Saltergate Drive and Summit View Road, located within the limits of the City of Dublin; and

WHEREAS, due to changing budgetary and service demands, it was necessary to defer the construction of the aforementioned improvements until 2020; and

WHEREAS, this legislation seeks to amend Ordinance 3503-2018 to reflect said work will be performed as part of the Resurfacing - 2020 projects and the revised estimated construction and inspection costs to be borne by the City of Dublin; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize this legislation in order to facilitate the execution of agreements with the City of Dublin and the acceptance and expenditure of requisite construction funding as soon as reasonably practicable so as to prevent delays in procurement and construction activities, thereby preserving the public health, peace, property, safety, and welfare; now therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That Ordinance 3503-2019 be and hereby is amended as follows:

Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to enter into agreements with the City of Dublin relative to Resurfacing - 2019 Project 1 the Resurfacing - 2020 projects, to accept contributions from Dublin to defray construction and inspection costs incurred during the completion of the project, and to, as necessary, provide a refund to Dublin after final accounting is complete or after certification from the Department of Public Service, Division of Design and Construction, that any funds remaining on deposit are no longer needed for the project and can be refunded.

Resurfacing - 2019 Project 1 The Resurfacing - 2020 projects encompass repairing and resurfacing various streets within the City of Columbus and constructing ADA curb ramps at those locations.  As part of that effort, the Department of Public Service plans to repair and resurface a portion of Sawmill Road from Saltergate Drive and Summit View Road, located within the limits of Dublin.  The City of Dublin shall assume and bear all associated construction and inspection costs. 

3.  FISCAL IMPACT

The City of Dublin has agreed to deposit $210,762.27 $147,297.58 with the Columbus City Treasurer to support work performed as part of Resurfacing - 2019 Project 1 the Resurfacing - 2020 projects; however, the actual amount owed by the City of Dublin for that purpose may vary from preliminary cost estimates, which may necessitate the acceptance of additional contributions from the City of Dublin to facilitate the completion of said improvements.

WHEREAS, the Department of Public Service is administering Resurfacing - 2019 Project 1 the Resurfacing - 2020 projects, which encompass repairing and resurfacing various arterial streets and constructing ADA curb ramps at those locations; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 1.  That the Director of Public Service be and hereby is authorized to enter into agreements with and to accept contributions from the City of Dublin to defray construction and inspection costs incurred during the completion of Resurfacing - 2018 Project 1 the Resurfacing - 2020 projects, and to, as necessary, provide a refund to Dublin after final accounting is complete or after certification from the Department of Public Service, Division of Design and Construction, that any funds remaining on deposit are no longer needed for the project and can be refunded.

SECTION 2.  That prior existing Section 1 of Ordinance 3503-2019 is hereby repealed.

SECTION 3.                     That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
