Explanation

1.  BACKGROUND

This legislation authorizes the Director of Public Service to modify the Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek) contract with Strand Associates, Inc.

Ordinance 2850-2018 authorized the Director of Public Service to enter into a professional services contract with Strand Associates, Inc., for the Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek) project in an amount of up to $233,880.99.  The intent of this project was to design sidewalk for the south side of Worthington Woods Boulevard to fill gaps between Sancus Boulevard and Worthington Galena Road; for the south/east side of Worthington Woods Boulevard from Worthington Galena Road to Deer Creek Drive; and for the north side of Park Road from Worthington Woods Boulevard to Deer Creek Drive.  Curb and gutter were planned to be installed as needed during construction of the project along with storm sewer facilities. 

 

This ordinance authorizes the Director of Public Service to modify the contract to add funds in an amount up to $170,000.00 for additional design needed for the project.  This is an unplanned modification that is necessary due to a change in the scope of the project.  The project’s original scope was to install sidewalk.  However, in consultation with Metro Parks, this corridor has been identified as a major connector and as such the sidewalk is being upgraded to a ten-foot wide shared use path.  It was deemed to be more cost efficient to modify the existing contract than to bid the design change.

Searches in the System for Award Management (Federal) and the Findings for Recovery list (State) produced no findings against Strand Associates, Inc.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for Strand Associates, Inc., is CC007735 and expires 10/4/21.

 

3.  FISCAL IMPACT

Funding in the amount of $170,000.00 is available within the Streets and Highways Bond Fund, Fund 7704.  An amendment to the 2019 Capital Improvements Budget is necessary to provide sufficient budget authority for this contract modification.  A transfer of funds and appropriation within Fund 7704 is necessary to align funding for these project expenditures.

 

4.  EMERGENCY DESIGNATION

Emergency action is requested to prevent delays in the project schedule.

Body

WHEREAS, contract PO146705 with Strand Associates was authorized by Ordinance 2850-2018 for the Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek) project in an amount up to $233,880.99; and

 

WHEREAS, this project scope has changed from installing sidewalks to installing shared use path; and

 

WHEREAS, it has become necessary to modify the contract in an amount up to $170,000.00 to provide additional funds for the Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek) project to accomodate this change in project scope; and

 

WHEREAS, it is necessary to amend the 2019 Capital Improvement Budget to establish sufficient budget authority for the project; and

 

WHEREAS, it is necessary to and transfer cash and appropriation within Fund 7704, the Streets and Highways Bond Fund, to provide funding for project expenditures; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to enter into a contract modification with Strand Associates to prevent delays in the project schedule, thereby preserving the public health, peace, safety, and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

                     

SECTION 1.  That the 2019 Capital Improvements Budget authorized by Ordinance 1326-2019 be amended to establish sufficient authority for this project as follows:

SECTION 2.  That the transfer of $153,280.00, or so much thereof as may be needed, is hereby authorized within Fund 7704 (Streets and Highways Bond Fund), from Dept-Div 5911 (Infrastructure Management), Project P540002-100084 (Bikeway Development - Hard Road at SR315 Crossing at Olentangy Trail), Object Class 06 (Capital Outlay) to Dept-Div 5911 (Infrastructure Management), Project P590105-100127  (Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Service be, and hereby is, authorized to enter into a contract modification with Strand Associates, Inc., 4433 Professional Parkway, Columbus, Ohio, 43125, for the Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek) project in the amount of $170,000.00, or so much thereof as may be needed.

 

SECTION 4.  That the expenditure of $170,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5911 (Infrastructure Management), Project P590105-100127  (Pedestrian Safety Improvement - Worthington Woods Boulevard Sidewalks (Sancus to Deer Creek)) in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
