Explanation

1.  BACKGROUND

This ordinance authorizes the expenditure of $161,598.00 to support the completion of the FRA-62-8.57 Urban Paving Project, PID 105506.

 

The aforementioned project, which is being administered by the Ohio Department of Transportation (ODOT), encompasses resurfacing those portions of Harrisburg Pike (U.S. 62) located within the Columbus corporate boundaries between 300’ south of Hyde Road and 100’ north of Belmead Avenue, including pavement repair and pavement markings, lying within the City of Columbus.

 

Ordinance 2766-2018 authorized the Director of Public Service to grant consent and propose cooperation with ODOT for the aforesaid project and noted that the encumbrance and expenditure of requisite funding would be authorized under a separate ordinance.

 

Ordinance 2515-2019 authorized the Director of Public Service to enter into agreements with and provide funding in the amount of $172,680.00 to ODOT for the aforementioned project.  Following the passage of that legislation, ODOT elected to postpone the bid until early 2020, and the Auditor’s Certificate established pursuant thereto consequently was cancelled to allow the encumbered funds to be reallocated for other purposes.

 

ODOT now intends to solicit bids for the project in March and recently provided the Department of Public Service with a revised cost estimate showing the cost attributable to the City is $161,598.00.

 

2.  FISCAL IMPACT

Funding in the amount of $161,598.00 is available within the Streets and Highways Bond Fund, Fund 7704, to support the local share of estimated construction costs; however, the final cost to the City may vary based on the results of the competitive bidding process administered by ODOT.  It is necessary to amend the 2019 Capital Improvement Budget to establish sufficient budget authority for this expenditure.  If additional funding is needed from the City after the results of the bid for this proejct are known, those funds will be requested separately pursuant to another ordinance. 

 

3.  EMERGENCY DESIGNATION

Emergency action is requested so as to allow the City to make payment on-time to ODOT to allow ODOT to maintain the planned project completion schedule.

Body

WHEREAS, the Ohio Department of Transportation (ODOT) is administering the FRA-62-8.57 Urban Paving Project, PID 105506, which encompasses resurfacing a portion of Harrisburg Pike (U.S. 62) between Hyde Road and Belmead Avenue, located within the Columbus corporate boundaries; and

 

WHEREAS, Ordinance 2766-2018 authorized the Director of Public Service to grant consent and to agree to cooperate with ODOT relative to the FRA-62-8.57 Urban Paving Project, PID 105506; and

 

WHEREAS, Ordinance 2515-2019 authorized the Director of Public Service to enter into agreements with and provide funding in the amount of $172,680.00 to ODOT for the aforementioned project; and

 

WHEREAS, ODOT originally planned to let the project on November 21, 2019, but elected to postpone the bid until early 2020; and

 

WHEREAS, the Auditor’s Certificate established pursuant to Ordinance 2515-2019 was cancelled to allow the encumbered funds to be reallocated for other purposes; and

 

WHEREAS, ODOT now intends to solicit bids in March for the FRA-62-8.57 Urban Paving Project, PID 105506; and

 

WHEREAS, this ordinance authorizes the expenditure of $161,598.00 to support the completion of that project; and

 

WHEREAS, it is necessary to amend the 2019 Capital Improvement Budget to establish sufficient budget authority for this expenditure; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is necessary to make payment to ODOT on time to allow ODOT to maintain the planned project completion schedule, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2019 Capital Improvements Budget authorized by Ordinance 1326-2019 be amended to establish sufficient authority for this project as follows:

SECTION 2.  That the Director of Public Service be and hereby is authorized to make payment to the Ohio Department of Transportation relative to the FRA-62-8.57 Urban Paving Project, PID 105506.

 

SECTION 3.  That the expenditure of $161,598.00, or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 59-11 (Division of Infrastructure Management), Project P530282-100128 (Resurfacing - Urban Paving - FRA-62-8.53 (Harrisburg Pike)), in Object Class 06 (Capital Outlay), per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
