Explanation

 

This ordinance is to authorize the Director of Recreation and Parks to modify an existing contract with OHM Advisors for staff augmentation services (Ord.1885-2019). This request will modify the existing contract by $300,000.00 (new contract total of $733,610.00) for the continuation of staff augmentation services for the department and will be funded by established Auditor’s Certificates (Ord. 2453-2018 & Ord. 0433-2020).

 

Background: 

 

Ord. 1885-2019 authorized OHM Advisors to provide staff augmentation services for a fee of $433,610.00. These funds are nearly depleted and the Division of Design and Construction has an urgent need for these services in order to keep its projects on course for successful completion. This ordinance will authorize the modification of PO174779 by $300,000.00 for a total new contract total of $733,610.00. This modification will be funded by the auditor’s certificates established by Ord. 2453-2018 and Ord. 0433-2020, and doing so will keep existing projects on course.

 

Ord. 2453-2018 originally established an ACPO ($450,000) for the future award of contracts for Architectural, Engineering, and Construction Management Services.  This ACPO value was amended by $275,000 (to $725,000.00) with Ord. 1885-2019.  These funds are nearly expended and the ACPO is approaching its yearly expiration.  Ordinance 0433-2020 recently established a new ACPO for the same General Engineering, Architectural, and Construction Management services, for an amount of $450,000. 

 

With the recent vacancies experienced by the Department, the need to augment staff has continued.  Contracts need to be awarded to Consultants that have been pre-qualified in accordance with Columbus City Code, Title 3, Section 329.26 and by Ordinance 2453-2018. Services that will be provided by this requested increase include:

                     Professional Architectural/Engineering Services

                     Construction Management and Inspection Services

 

Consultants received request and had been pre-qualified in accordance with Columbus City Code, Title 3, Section 329.26 and by Ordinance 2453-2018.  Selection was a quality based selection and costs for services were not requested.

In accordance with City Code, a selection team evaluated the proposals and recommended OHM Advisors be selected to perform the work.  The firm was chosen based on their referenced projects, experience, qualifications, availability, timeline, and project approach.

 

RFP’s were sent to our pre-qualified consultants listed above, in accordance with City Code Section 329, on May 14, 2019 and received by the Recreation and Parks Department on May 20, 2019.

Emergency Justification: An emergency is being requested in order to approve the modification for unanticipated and/or emergency service needs as soon as possible. In addition, with the recent vacancies experienced by the Department, the need to augment staff has increased from what was originally anticipated in order to keep existing projects moving forward.

 

Benefits to the Public: Having this funding in place for unanticipated needs as they arise will benefit the community by helping to ensure that parks, trails, and facilities remain accessible, safe, updated, and user friendly.

Master Plan Relation: This project will support the mission of the Recreation and Parks Master Plan by helping to ensure that the parks, trails, and facilities remain accessible, safe, updated, and able to be used by the public.

 

Fiscal Impact: The expenditure and contract amount of $433,610.00 was authorized for staff augmentation services by 2453-2018 and 1885-2019. This ordinance will provide authorization that will modify the previously authorized contract amount by $300,000.00. Existing Auditor’s Certificate will be used to fund this contract modification. ACPO003513 was established by 2453-2018 and ACPO005106 was established by 0433-2020 for architectural, engineering, and construction management services in conjunction with various improvement projects within the Recreation and Parks Department. These Auditor’s Certificates will be used to fund the contract modification noted herein. 

 

Title

 

To authorize the Director of Recreation and Parks to modify an existing contract with OHM Advisors for staff augmentation services; to authorize the expenditure of $300,000.00 from existing Auditor’s Certificates; and to declare an emergency. ($300,000.00)

 

Body

 

WHEREAS, it is necessary to authorize Director of Recreation and Parks to modify an existing contract with OHM Advisors for staff augmentation services, previously authorized by Ord.1885-2019; and

 

WHEREAS, it is necessary to authorize the expenditure of $300,000.00 from existing Auditor’s Certificates; ACPO003513 was established by 2453-2018 and ACPO005106 was established by 0433-2020; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Recreation and Parks in that it is immediately necessary to authorize the Director to modify an existing contract with OHM Advisors for staff augmentation services in order to keep existing projects moving forward, thereby preserving the public health, peace, property, safety, and welfare;  NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks is hereby authorized to modify a contract with OHM Advisors for staff augmentation services. The previously authorized amount of $433,610 will be modified by $300,000.00 for a total new contract total of $733,610.00.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. That, for the purpose stated in Section 1, the expenditure of $300,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from existing Auditor’s Certificates. ACPO003513 was established by 2453-2018 and ACPO005106 was established by 0433-2020 for architectural, engineering, and construction management services in conjunction with various improvement projects within the Recreation and Parks Department. These Auditor’s Certificates will be used to fund the contract modification noted herein. 

 

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
