Explanation
1. BACKGROUND
This ordinance authorizes the execution of agreements and transfer of funds between the Department of Public Service and the Franklin County Engineer’s Office relative to the proposed installation of a traffic signal at the intersection of Stelzer Road and Lifestyle Boulevard.
The City of Columbus is annexing territory in Mifflin Township in the vicinity of the intersection of Stelzer Road and Lifestyle Boulevard. The Franklin County Board of Commissioners approved Resolution 0133-2020 permitting the annexation of 3.54± acres in Mifflin Township to the City of Columbus on February 25, 2020. That action was preceded by and predicated on the passage of Ordinance 0271-2020, which set forth a statement of municipal services and zoning conditions for the proposed annexation area, by City Council on February 3, 2020.
That ordinance also noted that the annexation was conditioned on the transfer of $25,000 from the Franklin County Engineer’s Office to the Department of Public Service to be applied to the potential future construction of a traffic signal at the intersection of Stelzer Road and Lifestyle Boulevard. That sum represents funds deposited with the Franklin County Engineer by Bradford Schools relative to a separate, earlier rezoning application authorized pursuant to Ordinance 0955-2005.
2. EMERGENCY DESIGNATION
Emergency action is requested to allow for the execution of agreements between the Department of Public Service and the Franklin County Engineer’s Office to facilitate the transfer and acceptance of the aforementioned funds as soon as reasonably practicable.

To authorize the Director of Public Service to enter into agreements with the Franklin County Engineer’s Office and to accept from the same the sum of $25,000.00 relative to the proposed installation of a traffic signal at the intersection of Stelzer Road and Lifestyle Boulevard; and to declare an emergency. WHEREAS, the Franklin County Board of Commissioners approved Resolution 0133-2020 permitting the annexation of 3.54± acres in Mifflin Township to the City of Columbus on February 25, 2020; and
WHEREAS, that action was preceded by and predicated on the passage of Ordinance 0271-2020, which set forth a statement of municipal services and zoning conditions for the proposed annexation area, by City Council on February 3, 2020; and
WHEREAS, that legislation noted that the annexation was conditioned on the transfer of $25,000 from the Franklin County Engineer’s Office to the Department of Public Service to be applied to the potential future construction of a traffic signal at the intersection of Stelzer Road and Lifestyle Boulevard; and
WHEREAS, it is necessary for the Department of Public Service and the Franklin County Engineer’s Office to enter into an agreement, and future amendments or modifications thereto if needed, to effect that end; and
WHEREAS, an emergency exists within the Department of Public Service in that it is immediately necessary to authorize the execution of requisite agreements between the Department of Public Service and the Franklin County Engineer’s Office to facilitate the transfer and acceptance of the aforementioned sum as soon as reasonably practicable, thereby preserving the public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Service is hereby authorized to execute an agreement, and future amendments or modifications thereto if needed, with the Franklin County Engineer’s Office and to accept from Franklin County the sum of $25,000, which represents the funds deposited with the County Engineer by Bradford Schools to support the proposed installation of a traffic signal at the intersection of Stelzer Road and Lifestyle Boulevard pursuant to Ordinance 0955-2005.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
