Title: To authorize the Director of Public Service to enter into agreements with, and to accept funding from, Franklin County and/or the Franklin County Transportation Improvement District relative to the Arterial Street Rehabilitation - Morse Road Phase 1 (Seward Street to Stygler Road) project; to authorize the Director of Public Service to refund any unspent balance of funding deposited by Franklin County, if necessary; and to declare an emergency. Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to execute agreements with and to accept funding from Franklin County and/or the Franklin County Transportation Improvement District "FCTID" relative to the Arterial Street Rehabilitation - Morse Road Phase 1 (Seward Street to Stygler Road) project.

The aforementioned project encompasses various improvements to Morse Road, including widening and resurfacing Morse Road to provide additional through lanes and turn lanes and widening I-270 ramps B, C and D.

The Franklin County Board of Commissioners recognizes the economic, environmental, and safety benefits inherent to the project and has allocated up to $2,000,000.00 to support the construction of said improvements.  Those funds will be disbursed by the FCTID.

 

This legislation also authorizes the appropriation of the funds received from Franklin County and the FCTID and the issuance, as necessary, of a refund of the unspent balance of the funds received from Franklin County and the FTCID after the project and final accounting have been completed or when the Department of Public Service, Division of Design and Construction, certifies said funds are no longer needed and can be returned to Franklin County.

  

2.  FISCAL IMPACT

Franklin County has agreed to provide a lump sum contribution, not to exceed $2,000,000.00, to support the construction of the aforementioned project.  Additional contributions from a developer (MORSO) and a grant through the State of Ohio will also be used to construct the project.  The City is not contributing funding to this project.  

 

3.  EMERGENCY DESIGNATION

Emergency action is requested to make requisite construction funding available as soon as reasonably practicable so as to prevent unnecessary delays in the completion of needed public infrastructure improvements.

Body

WHEREAS, the City is administering the Arterial Street Rehabilitation - Morse Road Phase 1 (Seward Street to Stygler Road) project, which encompasses various improvements to Morse Road, including widening and resurfacing Morse Road to provide additional through lanes and turn lanes and widening I-270 ramps B, C and D; and

WHEREAS, the Franklin County Board of Commissioners recognizes the economic, environmental, and safety benefits inherent to the project and has allocated up to $2,000,000.00, which will be disbursed by the Franklin County Transportation Improvement District, to support the construction of said improvements; and

WHEREAS, it is necessary to authorize the Director of Public Service to enter into agreements with, and to accept funding from, Franklin County for that purpose; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to enter into agreements in order to make requisite construction funding available as soon as reasonably practicable to prevent unnecessary delays in the completion of needed public infrastructure improvements, thereby preserving the public health, peace, property, safety and welfare; now, therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Service be and hereby is authorized to enter into agreements, including any future amendments or modifications thereto, if needed, with, and to accept funding from, Franklin County and/or the Franklin County Transportation Improvement District  relative to the construction of the Arterial Street Rehabilitation - Morse Road Phase 1 (Seward Street to Stygler Road) project.

SECTION 2.  That the Director of Public Service be and is hereby authorized to, as necessary, refund any unspent balance of the funding deposited by Franklin County and/or the Franklin County Transportation Improvement District after the project and final accounting have been completed or when the Department of Public Service, Division of Design and Construction, certifies said funds are no longer needed and can be returned to Franklin County.

 

SECTION 3.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
