Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to enter into professional services contracts with Burgess & Niple in the amount of up to $500,000.00 for the Arterial Street Rehabilitation - E. Broad St. - Outerbelt St. to Reynoldsburg-New Albany Rd. project.

 

The intent of this project is to design improvements to the East Broad Street corridor from Outerbelt Street to Reynoldsburg-New Albany Road.  This is the second phase of a major widening project to construct new through and turn lanes of various configurations in the E. Broad Street corridor from the east side of the I-270 interchange to the intersection of E. Broad Street and Reynoldsburg-New Albany Road.  This project will widen and resurface the existing pavement from the eastern terminus of Phase 1 (near Outerbelt Street) to Reynoldsburg-New Albany Road.  Work will include widening of the bridge over Utzinger Ditch; traffic signal improvements; addition of a shared use path, sidewalk, street lighting, street trees, and signal interconnect conduit; and incidental improvements such as drainage, traffic control, sediment and erosion control, water adjustments, and maintenance of traffic.

The Department of Public Service, Office of Support Services, solicited Requests for Proposals for the Arterial Street Rehabilitation - E. Broad St. - Outerbelt St. to Reynoldsburg-New Albany Rd contract.  The project was formally advertised on the Vendor Services and Bonfire web sites from March 19, 2020, to April 9, 2020The City received four responses.  All proposals were deemed responsive and were fully evaluated when the Evaluation Committee met on April 16, 2020.  The responding firms were:

Burgess & Niple received the highest score by the evaluation committee and will be awarded the Arterial Street Rehabilitation - E. Broad St. - Outerbelt St. to Reynoldsburg-New Albany Rd contract. 

 

The initial contract amount of $500,000.00 is expected to fund preliminary engineering for the contract.  A contract modification will be required to add funds to do final engineering.  An ordinance requesting Council's approval to fund final engineering will be submitted when preliminary engineering has been completed and the amount needed for final engineering is known.

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Burgess & Niple, Inc.

 

2.  CONTRACT COMPLIANCE

Burgess & Niple’s contract compliance number is CC004425 and expires 02/21/2022. 

 

3.  FISCAL IMPACT

Funding for this contract is available within Fund 7431, the East Broad Commercial TIF.  It is necessary to transfer cash between projects within Fund 7431 to establish cash with the proper project.  It is also necessary to appropriate the funds. 

 

4.  EMERGENCY DESIGNATION

Emergency action is requested to allow the design of these safety improvements to be completed at the earliest possible time.

Body

WHEREAS, there is a need to enter into a professional services contract for the department to implement improvements to the East Broad Street corridor from Outerbelt Street to Reynoldsburg-New Albany Road; and

 

WHEREAS, the Department of Public Service, Office of Support Services, solicited Requests for Proposals for the Arterial Street Rehabilitation - E. Broad St. - Outerbelt St. to Reynoldsburg-New Albany Rd project; and

 

WHEREAS, Burgess & Niple submitted the best overall proposal for this project; and

 

WHEREAS, it is necessary to enter into a contract with Burgess & Niple for the provision of professional engineering consulting services described above in the amount of up to $500,000.00; and

 

WHEREAS, it is necessary to authorize a transfer of funds between projects within Fund 7431, the East Broad Commercial TIF, to establish sufficient cash to pay for the project; and

 

WHEREAS, it is necessary to appropriate funds in Fund 7431, the East Broad Commercial TIF; and

 

WHEREAS, funds in the amount of up to $500,000.00 will be expended from Fund 7431, the East Broad Commercial TIF, to pay for this project; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director of Public Service to enter into contract with Burgess & Niple to allow the design of these safety improvements to be completed at the earliest possible time, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the transfer of $500,000.00, or so much thereof as may be needed, is hereby authorized within Fund 7431 (East Broad Commercial TIF), from Dept-Div 4402 (Economic Development), Project P431999-100000 (E. Broad TIF Unallocated), Object Class 06 (Capital Outlay) to Dept-Div 5912 (Design and Construction), Project P530103-100066 (Arterial Street Rehabilitation - E. Broad St - Outerbelt Street to Reynoldsburg-New Albany Rd), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 2.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2020, the sum of $500,000.00 is appropriated in Fund 7431 (East Broad Commercial TIF), Dept-Div 5912 (Design and Construction), Project P530103-100066 (Arterial Street Rehabilitation - E. Broad St - Outerbelt Street to Reynoldsburg-New Albany Rd), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Public Service be, and hereby is, authorized to enter into a professional services contract with Burgess & Niple at 5085 Reed Rd., Columbus, Ohio, 43220, for the Arterial Street Rehabilitation - E. Broad St. - Outerbelt St. to Reynoldsburg-New Albany Rd project in an amount up to $500,000.00.

 

SECTION 4.  That the expenditure of $500,000.00, or so much thereof as may be needed, is hereby authorized in Fund 7431 (East Broad Commercial TIF),  Dept-Div 5912 (Design and Construction), Project P530103-100066 (Arterial Street Rehabilitation - E. Broad St - Outerbelt Street to Reynoldsburg-New Albany Rd), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 5.  Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
