Explanation

1.  Background

The City of Columbus, Department of Public Service, received a request from the property owner, Crew SC Stadium Company, LLC, asking that the City allow a wall and gate to encroach into the public right-of-way for their project located along the south side of Nordecke Alley east of Columbus Crew Way.  This project is the site of the new Columbus Crew Stadium and the proposed encroachments will consist of a retaining wall and gate that will protrude into the public right-of-way as described below and shown on the attached exhibit.  The following ordinance authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant the encroachments to legally allow these items to extend into the public rights-of-way.  Installation of these elements will enhance the functions of the stadium and fit into the architectural desire.  A value of $500.00, to be deposited in Fund 7748, Project P537650, for granting the requested encroachments was established.

 

2.  Fiscal Impact

There is no cost to the City for granting the encroachments.  The City will receive a total of $500.00 to be deposited in Fund 7748, Project P537650, for granting the requested encroachments.

 

3.  EMERGENCY JUSTIFICATION 

Emergency action is requested to allow development of this project to proceed as currently scheduled.

Body

WHEREAS, the City of Columbus, Department of Public Service, received a request from the property owner, Crew SC Stadium Company, LLC, asking that the City allow a wall and gate to encroach into the public right-of-way for their project located along the south side of Nordecke Alley, east of Columbus Crew Way; and

 

WHEREAS, this project is the site of the new Columbus Crew Stadium and the proposed encroachments will consist of a retaining wall and gate that will protrude into the public right-of-way as described below and shown on the attached exhibit; and

 

WHEREAS, installation of these elements will enhance the functions of the stadium and fit into the architectural desire

 

WHEREAS, the following legislation authorizes the Director of the Department of Public Service to execute those documents necessary for the City to grant the encroachments to legally allow these items to extend into the public rights-of-way; and

 

WHEREAS, a value of $500.00 for the encroachment easements was established, to be deposited in Fund 7748, Project P537650; and

 

WHEREAS an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the right-of-way encroachments to prevent unnecessary construction delays to the project; thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Public Service is authorized to execute those documents necessary for the City to grant a wall and gate encroachment into the public right of way to Crew SC Stadium Company for their project located along the south side of Nordecke Alley east of Columbus Crew Way; to-wit:

 

ENCROACHMENT EASEMENT

0.049 ACRE

 

Situated in the State of Ohio, County of Franklin, City of Columbus, lying in Half Section 9, Township 5, Range 22 of the Refugee Lands, being on, over, and across the right-of-way dedicated to the City of Columbus as Nordecke Alley of record in Plat Book 127, Page 62, (all references are to the records of the Recorder’s Office, Franklin County, Ohio) and being more particularly described as follows:

BEGINNING at a corner common to said Nordecke Alley and Lot 2 as shown on that plat entitled “Confluence Village” of record in Plat Book 127, Page 62 conveyed to Confluence Community Authority by deed of record in Instrument Number 201912200171939, and at the easterly terminus of the southerly right-of-way line of Nordecke Alley;

Thence South 82° 20' 23" West, with said southerly right-of-way line and the northerly line of said Lot 2, a distance of 90.42 feet to a point;

Thence across the right-of-way of said Nordecke Alley, the following courses and distances:

North 07° 39' 37" West, a distance of 23.00 feet to a point;

North 82° 20' 23" East, a distance of 45.38 feet to a point of curvature;

with the arc of a curve to the right, having a central angle of 08° 47' 55", a radius of 187.00 feet, an arc length of 28.72 feet, a chord bearing of North 86° 44' 21" East and chord distance of 28.69 feet to a point;

North 72° 29' 24" East, a distance of 13.10 feet to a point;

South 85° 46' 52" East, a distance of 10.83 feet to a point on the easterly terminus of said Nordecke Alley, being the right-of-way line thereof, and a westerly line of said Lot 2;

Thence South 11° 05' 19" West, with said easterly terminus line and said westerly line, a distance of 21.98 feet to the POINT OF BEGINNING, containing 0.049 acre (2122 square feet), more or less.

SECTION 2.  That, as consideration for granting the easements, the City is to receive $500.00 to be deposited in Fund 7748, Project P537650.

 

SECTION 3.  That, for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
