Explanation

1.  BACKGROUND

This ordinance authorizes the Director of Public Service to enter into agreements with and to provide funding to the Central Ohio Transit Authority (COTA) relative to the LinkUS - East-West Corridor project.

 

The aforementioned project, which is being administered by COTA, will identify high-capacity transit and other multi-modal improvements for a signature mobility corridor extending through Columbus and adjacent jurisdictions.  The project is divided into three geographies:

                     West Broad Street from Galloway Road on the west to downtown Columbus.

                     East Main Street/East Broad Street, from downtown Columbus to the Franklin County line (east).

                     Downtown Columbus connection area.

 

That effort is aligned with other City-led projects encompassing integrated mobility planning, land use, economic development, and housing strategies for each geography.  The City, acting through the Department of Public Service, has agreed to contribute up to $544,256.14 toward the completion of the LinkUS - East-West Corridor project.

 

2.  CONTRACT COMPLIANCE

The contract compliance number for COTA is CC004318, which expires on July 2, 2021.

 

3.  FISCAL IMPACT

Funding in the amount of $544,256.14 is available within the Streets and Highways Improvement Non-Bond Fund, Fund 7766An amendment to the 2019 Capital Improvement Budget is necessary for the purpose of providing sufficient budget authority for this expenditure.  A transfer of cash within Fund 7766 is necessary to align cash with the proper project.  Funds will also need to be appropriated within Fund 7766 for the expenditure.

4.  EMERGENCY DESIGNATION

Emergency action is requested in order to allow the City to maintain the project schedule agreed to with COTA.

Body

WHEREAS, the Central Ohio Transit Authority (COTA) is administering the LinkUS - East-West Corridor project, which will identify high-capacity transit and other multi-modal improvements for portions of Main Street, Broad Street, and the Downtown Connection area; and

 

WHEREAS, that effort is aligned with other projects being administered by the Department of Public Service; and

 

WHEREAS, the Department of Public Service has agreed to contribute up to $544,256.14 toward the completion of the LinkUS - East-West Corridor project, also known as the Roadway - East-West Corridor project; and

 

WHEREAS, this ordinance authorizes the Director of Public Service to execute agreements with COTA relative to that project; and

 

WHEREAS, it is necessary to authorize an amendment to the 2019 Capital Improvement Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; and

 

WHEREAS, a transfer of cash within Fund 7766 is necessary to align cash with the proper project; and

WHEREAS, funds will need to be appropriated within Fund 7766; and

WHEREAS, COTA must be paid for the City's share of the project; and

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the Director to enter into agreements with COTA in order to allow the City to satisfy the obligation owed to COTA as soon as reasonably practicable so as to maintain the project schedule agreed to with COTA, thereby preserving the public health, peace, property, safety, and welfare; now therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2019 Capital Improvement Budget, authorized by Ordinance 1326-2019, be and is hereby amended to provide sufficient budget authority for the appropriate projects authorized within this ordinance as follows:

SECTION 2.  That the transfer of $544,256.14, or so much thereof as may be needed, is hereby authorized within Fund 7766 (Streets and Highways Improvement Non-Bond Fund), from Dept-Div 5912 (Design and Construction), Project P766999-100000 (59-03 Unallocated Balance Fd. 766), Object Class 06 (Capital Outlay), to Dept-Div 5912 (Design and Construction), Project P531042-100000 (Roadway - East-West Corridor), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2020, the sum of $544,256.14 is appropriated in Fund 7766 (Streets and Highways Improvement Non-Bond Fund), Dept-Div 5912 (Design and Construction), Project P531042-100000 (Roadway - East-West Corridor), in Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 4.  That the Director of Public Service be and hereby is authorized to enter into agreemeents with Central Ohio Transit Authority to facilitate the completion of the LinkUS - East-West Corridor project, also known as the Roadway - East-West Corridor project.

 

SECTION 5.  That the expenditure of $544,256.14, or so much thereof as may be needed, be and hereby is authorized in Fund 7766 (Streets and Highways Improvement Non-Bond Fund), Dept-Div 5912 (Design and Construction), Project P531042-100000 (Roadway - East-West Corridor), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.

 

SECTION 6.  That the funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 9.  That for the reasons stated in the preamble hereto, which is made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes this ordinance.
