Explanation
Pursuant to Article 2, Section 2.4 of the Collective Bargaining Agreement (“Contract”) June 16, 2017 through June 15, 2020 between the City and the Fraternal Order of Police, Ohio Labor Council Inc. ("O.L.C."), any changes to the Contract must be in writing and signed by both parties. Whereas the Contract would have expired on June 15, 2020 under Article 28; however, due to the ongoing concerns about the COVID-19 pandemic, and following the advice of public health officials surrounding this pandemic, the parties have agreed to extend the current terms and conditions of the Contract until August 31, 2021, with the lone addition of Memorandum of Understanding #2020-01.
All current O.L.C. pay ranges provide for annual step increases except for pay range SR. The Criminal Intelligence Analysts are the only classification in pay range SR, and therefore, are not eligible for an annual step increase. Memorandum of Understanding #2020-01 has been executed by the parties to make the Criminal Intelligence Analysts eligible for a percentage based progression of three percent (3%) above their hourly rate effective on November 1, 2020, lieu of an annual step increase in pay range SR.The cost will be borne by the Division of Police.
The passage of this ordinance indicates Council's acceptance of Memorandum of Understanding #2020-01, a copy of which is attached hereto.
Emergency action is recommended in order to implement the terms of the Memorandum of Understanding in a timely manner.

WHEREAS, representatives of the City and the O.L.C. extend the current terms and conditions of the Contract dated June 16, 2017 through June 15, 2020 until August 31, 2021, and to accept Memorandum of Understanding #2020-01, copies of which are attached hereto, to make the Criminal Intelligence Analysts eligible for a percentage based progression of three percent (3%) above their hourly rate effective on November 1, 2020, lieu of an annual step increase; and
WHEREAS, emergency action is recommended in order to implement the terms of the Contract extension and Memorandum of Understanding in a timely manner; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to amend the Contract between the City and the O.L.C., by accepting Memorandum of Understanding #2020-01; thereby preserving the public peace, property, health, safety, and welfare; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Contract dated June 16, 2017 through June 15, 2020 between the City and O.L.C. is extended until August 31, 2021.
SECTION 2. That Memorandum of Understanding #2020-01 amends the extended Contract by adding eligibility for a percentage based progression of three percent (3%) for the Criminal Intelligence Analysts in pay range SR.
SECTION 3. That City Council, in the best interests of the City, hereby, recognizes and accepts the extension and Memorandum of Understanding #2020-01, copies of which are attached hereto, executed between representatives of the City and O.L.C.
SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
