Explanation

 

1. BACKGROUND: This legislation authorizes the Director of Public Utilities to modify and increase an existing engineering agreement with Strand Associates, Inc. for the Sewer Maintenance Operations Center (SMOC) Facility Stormwater Improvements. The purpose of this project is to perform the requisite investigation, evaluation, formulation and design work to produce fully independent construction documents for the installation of green infrastructure (GI) technologies and other related activities and/or documents necessary for project completion of mitigating stormwater issues at SMOC.

The project scope was expanded to include mitigation of stormwater noncompliance issue at the facility.  The additional funds will be utilized for additional design services necessary to complete project plan development including plan revisions requested by the DOSD, obtaining building permits, and to provide increased services during and post construction.

 

1.1. Amount of additional funds to be expended: $88,111.60

Original Contract $349,829.39

Modification 1     $208,933.10

Modification 2 (current) $88,111.60

Total $646,874.09

 

1.2 Reasons additional goods/services could not be foreseen:

This Contract Modification No. 2 was planned and anticipated, and stated in the original contract’s legislation. It is a planned continuation of the services originally included within the existing contract’s scope of service.

 

1.3 Reason other procurement processes are not used:

Re-bid of the project will likely result in a higher project costs as much of the project history would be lost and required to be rediscovered by another consultant unless won by the same consultant. In such a case, significant time would be wasted in acquiring and evaluating the new proposals without significant benefit.

 

1.4 How cost of modification was determined:

The costs of Contract Modification #2 were determined by negotiations between Strand Associates, Inc. and the DOSD.

ECONOMIC IMPACT: The project will install green infrastructure at DOSD’s Fairwood facility resulting in reduced runoff and improved water quality. The project will reduce inflow to the sanitary system mitigating sewerage overflows.

 

FISCAL IMPACT: This legislation authorizes an expenditure of $88,111.60 from the Storm Sewer Bonds Fund 6204.

 

 

Title

 

To authorize the Director of Public Utilities to modify and increase an existing agreement for professional engineering services with Strand Associates, Inc. for the Sewer Maintenance Operations Center (SMOC) Facility Stormwater Improvements for the Division of Sewerage and Drainage; and to authorize the expenditure of $88,11.60 within the Storm Sewer Bonds Fund 6204. ($88,111.60).

 

Body

 

WHEREAS, Contract No. EL016263 was authorized by Ordinance No. 1437-2014, passed July 28, 2014 for the Sewer Maintenance and Operations Center Stormwater Improvements Engineering Agreement; and

 

WHEREAS, Contract No. 072377 for Modification No. 1 was authorized by Ordinance No. 1392-2017, passed June 19, 2017 for continued work in support of Stormwater Improvements at the SMOC facility; and

 

WHEREAS, Contract Modification No. 2 (current) is a planned contract modification which will establish funding for continued work in support of Stormwater Improvements at the SMOC facility; and

 

WHEREAS, it is necessary to authorize the Director of Public Utilities to modify and increase the professional services agreement with Strand Associates, Inc. for the SMOC Facility Stormwater Improvements; and

 

WHEREAS, it is necessary to authorize an expenditure of funds from the Storm Sewer Bonds Fund 6204; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage, to authorize the Director to modify and increase the professional services agreement with Strand Associates, Inc., for the Sewer Maintenance Operations Center (SMOC) Facility Stormwater Improvements Project for the preservation of the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1: That the Director of Public Utilities is hereby authorized to modify and increase an existing engineering agreement with Strand Associates, Inc., 425 W. Nationwide Blvd. Suite 100, Columbus, Ohio 43215 in the amount of $88,111.60; in accordance with the terms and conditions of the contract on file in the Office of the Division of Sewerage and Drainage.

 

SECTION 2: That the Director of Public Utilities is hereby authorized to expend $88,111.60 from the Storm Sewer Bonds Fund 6204 per the account codes in the attachment to this ordinance.

 

SECTION 3. That the said firm, Strand Associates, Inc., shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.

 

SECTION 4. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 5. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7. That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 8. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
