Explanation

AN20-006

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN20-006) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on July 7, 2020. City Council approved a service ordinance addressing the site on July 20, 2020. Franklin County approved the annexation on August 11, 2020 and the City Clerk received notice on August 11, 2020.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

 

Title

To accept the application (AN20-006) of Trevi Properties and Airport Business Center LLC for the annexation of certain territory containing 2.8± acres in Mifflin Township.

Body

WHEREAS, a petition for the annexation of certain territory in Mifflin Township was filed on behalf of Trevi Properties and Airport Business Center LLC on July 7, 2020; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on August 11, 2020; and

WHEREAS, on August 11, 2020, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Trevi Properties and Airport Business Center LLC in a petition filed with the Franklin County Board of Commissioners on July 7, 2020 and subsequently approved by the Board on August 11, 2020 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Mifflin, and Quarter Township 4, Township 1, Range 17, United States Military District, and being all of the 0.253 acre parcel (APN 190-000340) as conveyed to Airport Business Center, LLC in Instrument Number 202002270029774, a portion of the 1.118 acre parcel (APN 190-001883) as conveyed to Airport Business Center, LLC in Instrument Number 201508270119913, all of the 0.862 acre parcel (APN 190-001884) as conveyed to Trevi Properties, LLC in Instrument Number 200703190047074, all of the 0.138 acre Parcel 7-WD as conveyed to the Franklin County Commissioners in Instrument Number 201204060047965, the 0.138 acre Parcel 6-WD as conveyed to the Franklin County Commissioners in Instrument Number 201202240026149, a portion of the 0.360 acre Parcel 5-WD as conveyed to the Franklin County Commissioners in Instrument Number 201401160006228, a portion of the Alfred Wolf property as conveyed in Deed Book 146, Page 581, and portions of the 1.088 acre (Auditor) Parcel Six and the 1.338 acre Parcel Seven as conveyed to Columbus Municipal Airport Authority in Instrument Number 199910050250577, with all record references cited herein being of the Franklin County Recorder's Office, Columbus, Ohio, and being further described as follows for annexation purposes:

Beginning for reference at a point at the centerline intersection of Stelzer Road (County Road 177) and Johnstown Road (County Road 377), and at the southwesterly corner of said Parcel 5-WD;

Thence N 55° 27' 51" E, along said centerline of Johnstown Road and the southerly line of said Parcel 5-WD, a distance of 55.5 feet to a point at the intersection of said centerline with the extension of the easterly right-of-way line of Stelzer Road (North), and the true point of beginning of the annexation area herein described;

Thence N 03° 29' 57" E, leaving said centerline of Johnstown Road, and crossing a portion of said Parcel 5-WD along said extension of the easterly right-of-way line of Stelzer Road, and along an easterly line of said Parcel 5-WD, the westerly line of said 0.253 acre parcel and an easterly line of the Highway Easement of record in Deed Volume 2416, Page 29, and crossing a portion of said 1.118 acre parcel, a distance of 343.1 feet to a point on a northerly line of said 1.118 acre parcel and the southerly line of the State of Ohio 0.048 acre Parcel 1004-WL of record in Deed Volume 3504, Page 770;

Thence N 56° 15' 51" E, leaving said State of Ohio Highway Easement, and along said northerly line of the 1.118 acre parcel and said southerly line of the 0.048 acre Parcel 1004-WL, a distance of 19.8 feet to a point on a westerly line of said 1.118 acre parcel, and at the southeasterly corner of said Parcel 1004-WL;

Thence N 17° 56' 59" W, along said westerly line of the 1.118 acre parcel and the easterly line of said 0.048 acre Parcel 1004-WL, a distance of 10.8 feet to a point at a northerly corner on of said 1.118 acre parcel, and at the southwesterly corner of the State of Ohio 0.093 acre Parcel 1000-WL of record in Deed Volume 3131, Page 393;

Thence N 55° 55' 31" E, leaving said easterly line of the 0.048 acre Parcel 1004-WL, and along a northerly line of the 1.118 acre parcel and the southerly line of said 0.093 acre Parcel 1000-WL, and along the northerly line of said 0.862 acre parcel and the southerly line of the State of Ohio 0.10 acre Parcel 1001-WL of record in Deed Volume 3115, Page 478, a distance of 298.5 feet to a point at the northeasterly corner of said 0.862 acre parcel and the southeasterly corner of said Parcel 1001-WL, and at the northwesterly corner of the 1.151 acre parcel as conveyed to Reginald J. Hayes and Mary E. Hayes in Instrument Number 199901060003702, and at the southwesterly corner of the State of Ohio 0.18 acre Parcel 1002-WL of record in Deed Volume 3242, Page 516, and said point also being on the City of Columbus Corporation Line (Ordinance Number 0689-2013, Instrument Number 201306170099888);

Thence S 18° 05' 32" E, along the easterly line of said 0.862 acre parcel and the westerly line of said 1.151 acre parcel, and along the easterly line of said 0.138 acre Parcel 7-WD, the westerly line of the 0.114 acre Parcel 8-WD as conveyed to the Franklin County Commissioners in Instrument Number 201207270107671 and said City of Columbus Corporation Line (Ordinance Number 0689-2013), a distance of 289.8 feet to a point on said centerline of Johnstown Road at the southeasterly corner of said Parcel 7-WD and the southwesterly corner of said Parcel 8-WD, and on the northerly line of said 1.338 acre Parcel Seven;

Thence N 55° 27' 51" E, along said centerline of Johnstown Road and said northerly line of the 1.338 acre Parcel Seven, and along the southerly line of said Parcel 8-WD and said City of Columbus Corporation Line (Ordinance Number 0689-2013), a distance of 11.3 feet to a point at the northeasterly corner of said Parcel Seven, and at the northwesterly corner of the 2.805 acre parcel as conveyed to said Columbus Municipal Airport Authority in Instrument Number 199910050250577;

Thence S 05° 10' 09" E, leaving said centerline of Johnstown Road, and along the easterly line of said 1.338 acre Parcel Seven, the westerly line of said 2.805 acre parcel and said City of Columbus Corporation Line (Ordinance Number 0689-2013),, a distance of 34.5 feet to a point on the existing southerly right-of-way line of said Johnstown Road, and said point also being on the City of Columbus Corporation Line (Ordinance Number 09-68, Miscellaneous Record 144, Page 491);

Thence S 55° 27' 51" W, leaving said easterly line of the 1.338 acre Parcel Seven and said westerly line of said 2.805 acre parcel, and crossing said 1.338 acre Parcel Seven and said 1.088 acre Parcel Six along said existing southerly right-of-way line of Johnstown Road, and being 30 feet southerly of, and perpendicular to, said centerline of Johnstown Road, the northerly line of said Parcel Seven and the northerly line of said Parcel Six, and along said City of Columbus Corporation Line (Ordinance Number 09-68, Miscellaneous Record 144, Page 491), the southerly line of said Alfred Wolf property, the northerly line of the 0.290 acre Parcel 4-WD as conveyed to the Franklin County Commissioners in Instrument Number 201304020053806, and along the City of Columbus Corporation Line (Ordinance Number 1649-74, Miscellaneous Record 163, Page 707) and City of Columbus Corporation Line (Ordinance Number 652-88, Official Record 11464 1-03), a distance of 468.8 feet to a point at the intersection of said southerly right-of-way line of Johnstown Road and said extension of the easterly right-of-way line of Stelzer Road (North);

Thence N 03° 29' 57" E, leaving said southerly right-of-way line of Johnstown Road, said southerly line of the Alfred Wolf property and said southerly line of the 0.290 acre Parcel 4-WD, and along said extension of the easterly right-of-way line Stelzer Road (North), a distance of 38.1 feet to the true point of beginning of the annexation area herein described, containing 2.8 acres, more or less.

The total length of the annexation perimeter for this annexation area is 1514.7 feet, of which 804.4 feet are contiguous with the existing City of Columbus Corporation Lines, being 53.1 % contiguous. This annexation does not create any islands of township property.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
