 Explanation

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify past, present and future contracts and purchase orders with Finley Fire Equipment Company, Inc.  Finley Fire Equipment Company, Inc. has been acquired by Atlantic Emergency Solutions, Inc.  This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus from Finley Fire Equipment Company, 31-0816583, to Atlantic Emergency Solutions, Inc., 27-3187193.

 

No additional funds are necessary to modify the option contract as requested.  There is no change in the type of products being procured and the original contract was formally bid.  The original terms and conditions remain in effect.

 

EMERGENCY DESIGNATION:  The Finance and Management Department respectfully requests this legislation be considered an emergency in order to maintain an uninterrupted supply of Pierce Manufacturing Parts and Services.

 

FISCAL IMPACT: No additional funding is required to modify the option contract.  The Department of Finance and Management must set aside their own funding for their estimated expenditures. 

 

Title

 

To authorize the Finance and Management Director to modify past, present and future contracts and purchase orders from Finley Fire Equipment Company, Inc. to Atlantic Emergency Solutions, Inc. and to declare an emergency.

 

Body

 

WHEREAS, the Finance and Management Department, Purchasing Office has an option contract and open purchase orders for Pierce Manufacturing Parts and Services for use by the Division of Fleet Management; and, 

 

WHEREAS, Finley Fire Equipment Company, Inc. has been acquired by Atlantic Emergency Solutions, Inc. and in addition to notifying the City, Atlantic Emergency Solutions, Inc. has agreed to honor the past, present and future contracts and agreements; and,

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to modify all contracts and purchase orders established and in process with Finley Fire Equipment Company, Inc., thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director is hereby authorized to modify all past, present and future contracts and purchase orders pursuant to those contracts to reflect the change from Finley Fire Equipment Company, Inc., 31-0816583 to Atlantic Emergency Solutions, Inc., 27-3187193.

 

SECTION 2. That this modification is in accordance with relevant provisions of Section 329 of the Columbus City Code. 

 

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
