Explanation

 

Background: This ordinance authorizes the Director of the Recreation and Parks Department to enter into contract with Tyevco Inc. for the Goodale Park UIRF 2020 Improvements Project. The contract amount is $398,039.00, with a contingency of $39,461.00, for a total of $437,500.00. An additional $3,500.00 is being authorized for interdepartmental inspections and fees for a total of $441,000.00 being authorized by this ordinance.

 

Goodale Park is a public park in the Victorian Village area of Columbus. It was donated to the city in 1851 by Lincoln Goodale. The Friends of Goodale Park, a non-profit community group, have been requesting improvements identified in this project and have been integrally involved in the development of this project. Improvements will include new water connections for irrigation of community gardens and plantings. New lighting along walkways will improve safety and re-lamping of existing lighting fixtures to LED will increase energy efficiency. The gazebo will also be renovated, improving the ADA access and the functional use of the facility for the public. We anticipate construction to begin in early 2021 and to be finished by late spring 2021. Funding has been identified through the Urban Infrastructure Recovery Fund (UIRF).

 

Vendor Bid/Proposal Submissions (ODI designation status):

 

Proposals were advertised through Vendor Services, in accordance with City Code Chapter 329, on October 27, 2020 and received by the Recreation and Parks Department on November 19, 2020. This project was also picked up by various local and regional plan rooms and distributed to their membership. Bids were received from the following companies:

 

Tyevco Inc. (MAJ): $398,039.00

R.W. Setterlin Building Company (MAJ): $435,200.00

Miles-McClellan Construction Co. (MBE): $473,175.00                    

Playworld Midstates (MAJ): Not Responsive

 

After reviewing the bids that were submitted, it was determined that Tyevco Inc. was the lowest and most responsive bidder. Tyevco Inc. and all proposed subcontractors have met code requirements with respect to prequalification, pursuant to relevant sections of Columbus City Code Chapter 329. It was determined that Playworld Midstates was not responsive in submitting form B5, which documents Subcontractors, per Columbus City Code Chapter 329

Emergency Justification: Emergency action is requested so that the contractor can begin work in early 2021 and be substantially complete with the work in the spring of 2021. The timing corresponds with the current closing of the shelterhouse and gazebo to accommodate these renovations, allowing the construction to occur when these facilities are not rented or in use.

Master Plan Relation: This project supports the department’s Master Plan by upgrading community parks. Improving infrastructure, such as lighting and ADA access, help make these parks safer, more usable, and accessible. Goodale Park is a large park that is seen as a community anchor. It is one of the oldest and most iconic parks within the city, holding numerous high-profile special events each year. Due to its high visibility, this park has a higher maintenance standard that is augmented by The Friends of Goodale Park, a non-profit organization, which has advocated for these improvements to the public space.

 

Fiscal Impact: $441,000.00 is budgeted and available from within the Recreation and Parks Voted Bond Fund 7702 to meet the financial obligations of this contract.

 

Title

 

To authorize the Director of Recreation and Parks to enter into contract with Tyevco Inc. for the Goodale Park UIRF 2020 Improvements Project; to authorize the expenditure of $441,000.00 from the Recreation and Parks Voted Bond Fund; and to declare an emergency. ($441,000.00)

 

Body

 

WHEREAS, it is necessary to authorize the Director of the Recreation and Parks to enter into contract with Tyevco Inc. for the Goodale Park UIRF 2020 Improvements Project; and

 

WHEREAS, it is necessary to authorize the expenditure of $441,000.00 from the Recreation and Parks Voted Bond Fund 7702; and

 

WHEREAS, an emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to authorize the Director to enter into contract with Tyevco Inc. for the Goodale Park UIRF 2020 Improvements Project to allow construction to occur when these facilities are not rented or in use, all for the preservation of the public health, peace, property, safety, and welfare and, NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks be and is hereby authorized to enter into contract with Tyevco Inc. for the Goodale Park UIRF 2020 Improvements Project.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. For the purpose stated in Section 1, the expenditure of $441,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Recreation and Parks Voted Bond Fund 7702 in object class 06 Capital Outlay per the accounting codes in the attachments to this ordinance.

 

SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof,, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
