Explanation

 

1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Granite Construction Company for the Lower Olentangy Tunnel Project, CIP# 650724-100000.

 

The Lower Olentangy Tunnel will work in tandem with the four pillars of the Blueprint Columbus program to enable the City to address several elements of its sewer consent orders that the four pillars alone cannot improve water quality in the Olentangy River.  The project will provide hydraulic relief to both the Franklin Main Interceptor Sewer and the Olentangy Scioto Interceptor Sewer near Second Avenue and near Tuttle Park; it will also mitigate designed sewer relief structures per the consent order.

2.  THE PROJECT TIMELINE: All work shall be substantially complete by June 30, 2026, with final completion to occur by December 31, 2026. The City anticipates issuing a Notice to Proceed on or about May 1, 2021.

 

3.  CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened two (2) bids on December 23, 2020 from Granite Construction Company and Bonsai JV.  The bids were evaluated using the Bid Tabulation and Quality Factor Form processes.

3.1 PRE-QUALIFICATION STATUS: Granite Construction Company has met code requirements with respect to pre-qualification, pursuant to relevant sections of Columbus City Code Chapter 329. 

 

Granite Construction Company’s bid was deemed the lowest, best, most responsive and responsible bid in the amount of $267,753,200.00.  Their Contract Compliance Number is 94-0519552 (expires 9/22/2022, Majority) and their DAX Vendor Account No. is 033548. 

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Granite Construction Company.

 

4. EMERGENCY DESIGNATION is requested for this project in order to meet project time lines and deliverables.

 

5.  ECONOMIC/ENVIRONMENTAL IMPACT:  The Lower Olentangy Tunnel will work in tandem with the four pillars of Blueprint Columbus program to enable the City to address several elements of its sewer consent orders that the four pillars alone cannot, and improve water quality in the Olentangy River. 

 

6.  FISCAL IMPACT: This project has been approved for below market-rate loan financing through the Ohio Environmental Protection Agency’s Water Pollution Control Loan Fund (WPCLF) which is administered by the Ohio Water Development Authority (OWDA).  The loan award is expected in January 2021 when an OWDA Loan Account number will be assigned.  Federal Davis-Bacon Wage Rates and Requirements will apply.  Funding for Prevailing Wage Services ($2,000.00) payable to the Department of Public Service will come from the Sanitary G.O. Voted Bonds Fund 6109.  A transfer of $4 within Fund 6109 is necessary as well as an amendment to the 2020 Capital Improvement Budget is necessary to align budget authority with the proper project.

Body

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to enter into a construction contract with Granite Construction Company and to encumber and expend funds to provide for payment of prevailing wage services for the Division of Sewerage and Drainage’s Lower Olentangy Tunnel Project; and

 

WHEREAS, it is necessary to authorize an appropriation and expenditure of up to $267,753,200.00 within the Ohio Water Development Authority Loan Fund; and

 

WHEREAS, it is necessary to authorize a transfer of up to $4 and an expenditure of up to $2,000.00 within the Sanitary G.O. Voted Bonds Fund 6109 for Prevailing Wage Services; and

 

WHEREAS, it is necessary to authorize an amendment to the 2020 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditures; and

 

WHEREAS, an emergency exists in the usual daily operations of the Department of Public Utilities in that it is immediately necessary to authorize the Director to enter into a construction contract with Granite Construction Company for the Lower Olentangy Tunnel Project in order to meet project deadlines and deliverables, for the preservation of the public health, peace, property, and safety; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized to enter into a construction contract with Granite Construction Company, 2215 Sanders Rd., Suite 400, Northbrook, IL 60062 for the Lower Olentangy Tunnel Project in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage; and to obtain the necessary prevailing wage services from the Department of Public Services up to a maximum amount of $2,000.00.

 

SECTION 2.  That the 2020 Capital Improvements Budget is amended, as authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the appropriation and expenditure of up to $267,753,200.00, or so much thereof as may be needed, is hereby authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 4.  That the transfer within of up to $4 and expenditure of $2,000.00 to the Department of Public Service for prevailing wage services, or so much thereof as may be needed, is hereby authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  That the said company, Granite Construction Company, shall perform the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.

 

SECTION 6.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.

 

SECTION 7.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 8. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 9.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 10.  That for the reasons stated in the preamble hereto, which is made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes this Ordinance.
