Explanation

AN20-013

 

BACKGROUND:  This ordinance is being submitted to authorize the Director of Public Service to file a municipal annexation petition of a 0.384 acre site in Orange Township, Delaware County. The annexation involves right of way on the north side of Polaris Parkway, in vacated roadway of Worthington Road, and is being annexed to allow the City of Columbus to control, manage, and maintain an expanded stormwater basin that will reside at the site. Additionally, this ordinance provides for the acceptance of the property by the City upon approval of the petition by the Delaware County Commissioners. This ordinance is required by the Ohio Revised Code as enacted by the General Assembly of the State of Ohio.  Upon approval by City Council, a certified copy of this ordinance will be provided to the Delaware County Commissioners in conjunction with an annexation petition.

 

 FISCAL IMPACT:  This ordinance has no direct fiscal impact. Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

 

Title

To authorize the Director of Public Service to file a municipal petition for the annexation of 0.384 acres within Orange Township as provided in section 709.16 of the Ohio Revised Code and to provide for acceptance of the property by the City of Columbus upon approval of the petition by the Board of Delaware County Commissioners.

 

Body

WHEREAS, the City of Columbus owns 0.384 acres of right of way in Orange Township on the north side of Polaris Parkway, in vacated roadway of Worthington Road; and

 

WHEREAS, the site is not currently within the City of Columbus; and

 

WHEREAS, section 709.16 of the Ohio Revised Code allows for municipalities to file annexation petitions of territory owned by the municipality, a county or the state; and 

 

WHEREAS, the City is able to provide municipal services to this site; and

 

WHEREAS, authorization by City Council is necessary for submission of a municipal annexation petition to the Board of Delaware County Commissioners; and

 

WHEREAS, upon receipt of the petition by the City to annex the site, the Board of Delaware County Commissioners must take action within 30 days; and

 

WHEREAS,  whereas the City of Columbus desires to add the referenced territory described in detail in section 1 below to its boundaries if the petition is approved by the Board of Delaware County Commissioners; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the Director of Public Service is authorized to file a municipal petition for annexation as outlined in section 709.16 of the Ohio Revised Code for 0.384+/- acres in Orange Township, Delaware County, located on the north side of Polaris Parkway, in vacated roadway of Worthington Road and described more specifically as follows:

Situated in the State of Ohio, County of Delaware, Orange Township, and being in Farm Lot 17, Quarter Township 4, Township 3 North, Range 18 West of the United States Military Lands, being part of a roadway dedication plat as described in a plat to the City of Columbus of record in Dedication Plat of Polaris Parkway, Plat Book 24, page 137, of which 0.148 acres are in the proposed annexation; being a 0.715-acre tract as described in a deed to the City of Columbus of record in Official Record 541, Page 201, of which 0.057 acre are in the proposed annexation; and being a 0.3175-acre tract as described in a deed to the City of Columbus of record in Official Record 553, Page 810, of which 0.179 acre are in the proposed annexation, all references are to records of the Delaware County Recorder's Office, Delaware County, Ohio, and being more particularly described as follows:

 

Beginning for reference at the northeast comer of a 2.010-acre tract as described in a deed to 2200 Polaris Columbus Carwash, LLC of record in Official Record 1615, Page 2429;

 

Thence South 39° 54' 34" West along the easterly line of said 2.010-acre tract, also being the original westerly line of Olde Worthington Road, a distance of 30.60 feet to a point in the existing corporation line of the City of Columbus, as defined in City Ordinance# 3310-90, and being the TRUE POINT OF BEGINNING;

 

Thence South 50° 05' 26" East a distance of 60.00 feet (perpendicular to and passing the original centerline of right of way of said Olde Worthington Road at a distance of 30.00 feet) to the original easterly right-of-way line of said Olde Worthington Road;

 

Thence along said easterly line, also being the easterly line of said 0.3175-acre tract and the northerly line of a 2.896-acre tract conveyed to Giuseppe A. Pingue in Deed Volume 525, Page 650, South 39° 54' 34" West a distance of 203.69 feet to an angle point is said 0.3175-acre and 2.896-acre tracts;

 

Thence continuing along the easterly line of said 0.3175-acre tract, also being the northerly line of said 2.896-acre tract, South 51 ° 26' 28" West a distance of 68. 70 feet to the northerly right-of-way line of Polaris Parkway;

 

Thence along said northerly line South 89° 14' 54" West a distance of 60.99 feet to the westerly right-of-way line of said Olde Worthington Road, which is also the existing corporation line of the City of Columbus, as defined in City Ordinance# 2015-30;

 

Thence along said westerly line North 39° 54' 34" East a distance of 310.74 feet to the TRUE POINT OF BEGINNING and containing 0.384 acres in the proposed annexation.

 

Section 2. That the City of Columbus will accept the territory described in section 1 upon approval of the petition by the Board of Delaware County Commissioners.

 

Section 3. That the City Clerk is hereby authorized and directed to perform such acts as set forth in O.R.C. 709.06, or as otherwise required by law, in order to ensure the proper recording of the annexation.

 

Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
