Title: To authorize the Finance and Management Director to modify past, present and future contracts and purchase orders from Century Equipment to Jerry Pate Turf & Irrigation; and to declare an emergency.

 Explanation

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify past, present and future contracts and purchase orders with Century Equipment. Century Equipment has undergone a merger.  This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus from Century Equipment, Tax ID# 34-4478146 to Jerry Pate Turf & Irrigation, DBA Century Equipment, Tax ID# 59-3472632.

 

No additional funds are necessary to modify the four (4) option contracts as requested.  There is no change in the type of products being procured and the original contracts were formally bid.  The original terms and conditions remain in effect.

 

EMERGENCY DESIGNATION:  The Department of Finance and Management respectfully requests this legislation  be considered an emergency in order to maintain an uninterrupted supply of Club Cart Parts & Services, Ventrac Parts, Toro Irrigation Parts and Toro Small Engine & Grounds Equipment Parts.

 

FISCAL IMPACT: No additional funding is required to modify the four (4) option contracts.  The Department of Finance and Management must set aside their own funding for their estimated expenditures. 

 

Title

 

To authorize the Finance and Management Director to modify past, present and future contracts and purchase orders from Century Equipment to Jerry Pate Turf & Irrigation; and to declare an emergency.

 

Body

 

WHEREAS, the Finance and Management Department, Purchasing Office has four (4) option contracts and open purchase orders for Club Car Parts & Services, Ventrac Parts, Toro Irrigation Parts and Toro Small Engine & Grounds Equipment Parts for use by the Division of Fleet Management; and, 

 

WHEREAS, Century Equipment has merged with Jerry Pate Turf & Irrigation and in addition to notifying the City, Jerry Pate Turf & Irrigation has agreed to honor the past, present and future contracts and agreements; and,

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Finance and Management in that it is immediately necessary to modify all four (4) contracts and purchase orders established and in process with Century Equipment in order to maintain an uninterrupted supply of parts and equipment, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Finance and Management Director is hereby authorized to modify all past, present and future contracts and purchase orders pursuant to those contracts to reflect the change from Century Equipment Tax ID# 34-4478146 to Jerry Pate Turf & Irrigation, DBA Century Equipment Tax ID# 59-3472632.

 

SECTION 2. That this modification is in accordance with relevant provisions of Chapter 329 of the Columbus City Code. 

 

SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
