Explanation

AN20-010

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN20-010) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on September 2, 2020. City Council approved a service ordinance addressing the site on September 14, 2020. Franklin County approved the annexation on October 6, 2020 and the City Clerk received notice on January 11, 2021.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

 

Title

To accept the application (AN20-010) of RJM Star LLC for the annexation of certain territory containing 5.4± acres in Prairie Township.

 

Body

WHEREAS, a petition for the annexation of certain territory in Prairie Township was filed on behalf of RJM Star LLC on September 2, 2020; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on October 6, 2020; and

WHEREAS, on January 11, 2021, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by RJM Star LLC in a petition filed with the Franklin County Board of Commissioners on September 2, 2020 and subsequently approved by the Board on October 6, 2020 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situate in the State of Ohio, Franklin County, Prairie Township and being a part of VMS 1571 & 5243 and being all the property conveyed to RJM Star LLC as recorded in Inst. # 201902150018137 (Auditors parcel numbers 240-001893 and 240-005158) and being more particularly described as follows:

Beginning at the southeast corner of Lot 11 of the Summerlyn Section 1 Subdivision (PB 109 Pg. 68) and being the true point of beginning;

Thence along the east line of said subdivision, and the present corporation line of the City of Columbus as established by Ordinance# 2095-95 (OR 30484 B 14) and Ordinance# 454-94 (OR 26438 G20), northerly 863 feet to the south right-of-way of West Broad Street (US 40);

Thence, easterly along said right-of-way line, and along the present corporation line, 278 feet to an angle point in said line;

Thence, southeasterly 15 feet to the westerly right-of-way line and the current corporation line (Ord.# 0362-03 IN 200305150144539) as described in the deed to Franklin County Commissioners recorded in OR 25964-016 (Parcel 89-WD) (of Galloway Rd. (CR 141);

Thence, southerly 300 feet to an angle point in said right-of-way;

Thence, southerly 44 feet to an angle point in said right-of-way;

Thence, southerly 457 feet to an angle point in said right-of-way;

Thence, southerly 50 feet to an angle point in said right-of-way;

Thence, westerly along the northerly line of a 0.997 acre tract as described in the deed to Columbus & Southern recorded in DB 1667 Pg. 209, 280 feet to the point of beginning and containing 5.397 acres. Total perimeter of annexation area is 2287 feet, of which 2184 feet is contiguous with the City of Columbus having 95% contiguity.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
