Explanation

 

Background: This ordinance authorizes the Director of the Recreation and Parks Department to enter into contract with R.W. Setterlin Building Company for the Tuttle Park Lower Field Improvements Project. The contract amount is $848,636.70, with a contingency of $84,800.00, for a total of $933,436.70. An additional $86,800.00 is being authorized for interdepartmental inspections and fees for a total of $1,020,236.70 being authorized by this ordinance.

 

The amenities and sport courts within the eastern portion of the lower fields of Tuttle Park are in need of rehabilitation and improvement. This project is a response to several public requests for Tuttle Park improvements during the 2019 University District Plan Process. During the design phase, the Department coordinated with the Tuttle Community Recreation Center, University Area Commission, and other support groups to identify and prioritize park improvements. As a result, this construction contract will repair the existing futsal and tennis courts, relocate a new full size basketball court, improve park lighting, plant 31 trees, and provide a new amenity area. The new amenity area will include an open shelter, benches, picnic tables, bike racks, and a water bottle refill station. Additionally, this contract will build an ADA Accessible route to the lower fields from Oakland Avenue and Tuttle Recreation Center by removing a staircase and creating an ADA Compliant ramp. With an anticipated April 2021 start date, this contract will enable the Tuttle Park Lower Field Improvements Project to be constructed at the same time as the Tuttle Skatepark Project, recently authorized by 0331-2021, with the goal that they both be completed by December 2021.

 

Vendor Bid/Proposal Submissions (ODI designation status):

 

Proposals were advertised through Vendor Services and Bid Express, in accordance with City Code Section 329, on February 3, 2021 and received by the Recreation and Parks Department on February 23, 2021. This project was also picked up by various local and regional plan rooms and distributed to their membership. Bids were received from the following companies:

 

R.W. Setterlin Building Company (MAJ): $848,636.70

2K General Company, Inc. (MAJ): $924,000.00

 

After reviewing the bids that were submitted, it was determined that R.W. Setterlin Building Company was the lowest and most responsive bidder. R.W. Setterlin Building Company and all proposed subcontractors have met code requirements with respect to prequalification, pursuant to relevant sections of Columbus City Code Chapter 329.

Emergency Justification: Emergency action is requested to ensure the aggressive construction schedule for the Tuttle Park Lower Field Improvements Project aligns with the schedule for the Tuttle Skatepark Project, both scheduled to be substantially complete by December 2021.

 

Benefits to the Public: This project will update and expand recreational opportunities to residents near Tuttle Park and beyond, including expanding ADA accessibility into the park. Additionally, the improvements will provide additional amenities to the lower field to encourage residents to spend more time in the park. 

 

Community Input/Issues: The Tuttle Park Lower Field Improvements Project is an Urban Infrastructure Recovery Fund (UIRF) funded project and has been presented to the Tuttle Community Recreation Commission and University Area District communities. The design of the park improvements was driven through community input and direct requests by the neighborhood. This project has been accepted by the community members as important improvements to Tuttle Park.

 

Area(s) Affected: University District (44), All trail users and nearby residents will benefit due to the connectivity of this project, Olentangy West (38) Planning Area is directly adjacent to this project

 

Master Plan Relation: This project supports the department’s Master Plan by updating existing park infrastructure requested by the community. It also helps improve the health and wellness of the community by providing a safe and accessible place for all ages and skill levels to play. The new park improvements will create recreational opportunities for the neighborhood and increase awareness of the value of Tuttle Park by drawing in users from the greater community.

 

Fiscal Impact: $1,020,236.70 is budgeted and available from within the Recreation and Parks Voted Bond Fund 7702 and Permanent Improvement Fund 7747 to meet the financial obligations of this contract.

WHEREAS, it is necessary to authorize the Director of the Recreation and Parks to enter into contract with R.W. Setterlin Building Company for the Tuttle Park Lower Field Improvements Project; and

 

WHEREAS, it is necessary to authorize the appropriation of $110,000.00 within the Recreation and Parks Permanent Improvement Fund 7747; and

 

WHEREAS, it is necessary to authorize the transfer of $185,236.70.00 within the Recreation and Parks Voted Bond Fund 7702; and

 

WHEREAS, it is necessary to authorize the amendment of the 2020 Capital Improvements Budget Ordinance 2521-2020 in order to provide sufficient budget authority for this and future projects; and

 

WHEREAS, it is necessary to authorize the expenditure of $1,020,236.70 from the Recreation and Parks Voted Bond Fund 7702 and Permanent Improvement Fund 7747; and

 

WHEREAS, an emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to authorize the Director to enter into contract with R.W. Setterlin Building Company to ensure the aggressive construction schedule for the Tuttle Park Lower Field Improvements Project aligns with the schedule for the Tuttle Skatepark Project, both scheduled to be substantially complete by December 2021, all for the preservation of the public health, peace, property, safety, and welfare and, NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That the Director of Recreation and Parks be and is hereby authorized to enter into contract with R.W. Setterlin Building Company for the Tuttle Park Lower Field Improvements Project.

 

SECTION 2. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 4. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 5. That the appropriation of $110,000.00 is authorized within the Recreation and Parks Permanent Improvement Fund 7747 per the accounting codes in the attachment to this ordinance. 

 

SECTION 6. That the transfer of $185,236.70 or so much thereof as may be needed, is hereby authorized between projects within the Recreation and Parks Bond Fund 7702 per the account codes in the attachment to this ordinance.

 

SECTION 7. That the 2020 Capital Improvements Budget Ordinance 2521-2020 is hereby amended as follows in order to provide sufficient budget authority for this ordinance and future projects.

SECTION 8. For the purpose stated in Section 1, the expenditure of $1,020,236.70 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the Recreation and Parks Voted Bond Fund 7702 and Permanent Improvement Fund 7747 in object class 06 Capital Outlay per the accounting codes in the attachments to this ordinance.

 

SECTION 9. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
