Explanation

BACKGROUND:  This legislation authorizes the Director of the Department of Development to modify a contract with Mark Reigelman II/Reigelman LLC for an additional year to complete fabrication and installation of the artwork, Columbus Crystals: A Maker’s Monument, and increase project funding by $57,000.

The public art project, Columbus Crystals: The Makers Monument, is the city’s first 2% percent for art project. It augments the $25 Million Department of Public Service’s High Street Streetscape Improvements Project. A robust stainless steel crystalline piece, it contains thousands of cut-out images of items made in Columbus, both past and present (<https://columbusohdev.box.com/s/8wjr9745lmxdf23tegovi2kl05kjee13>). The artwork is in the fabrication, which may be affected by COVID-19 pandemic restrictions.

 

Several factors have increased project funding, including obstacles working within the complicated underground infrastructure of North High Street, for example, an older brick sewer located on the same side of the street as the art installation, exact coordinates unknown. Additional funds are needed to fund the sewer pipe location services, re-engineering of engineering specs to ascertain the potential load weight of the foundation on the sewer and necessary foundation re-design, a change in access to an electrical pull box further from the sculpture that increased the cost of lighting the sculpture, and other installation related costs.

Emergency action is required so that work related to the Art on High Public Art Project, Columbus Crystals: A Makers Monument, can continue to move forward with fabrication and installation without delay

 

FISCAL IMPACT:  Funding is available in the 2020 Capital Improvement Budget.

 

CONTRACT COMPLIANCE:  the vendor number is 027703 and expires 4/30/21.

 

Title

Body

WHEREAS, the public art proposal, Columbus Crystals: A Maker’s Monument, has received Columbus Art Commission approval and community support; and

 

WHEREAS, pandemic conditions of COVID19 have and may continue to affect fabrication and installation schedules necessitating a 12 month contract extension; and

 

WHEREAS, an additional $57,000.00 is necessary to complete the art project; and

 

WHEREAS, an emergency exists in the Department of Development in that it is immediately necessary to authorize the Director to modify the agreement with Mark Reigelman to support the Art on High public art process to allow for installation without delay, for the preservation of the public heath, peace, prosperity, safety, and welfare: NOW THEREFORE,; NOW THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2020 Capital Improvements Budget authorized by ordinance 2521-2020 be amended as follows to establish sufficient authority for this this project:

SECTION 2.  That the transfer of $57,000.00 or so much thereof as may be needed, is hereby authorized within Fund 7735 (Northland and Other Acquisitions), Dept-Div 44-06 (Planning) per the account codes in the attachment to this ordinance.

 

SECTION 3.  That the Director of Development be and is hereby authorized to modify the contract with Mark Reigelman II/Reigelman LLC to extend the term of contract for an additional twelve months and to increase it in an amount up to $57,000.

 

SECTION 4.  That for the purpose as stated in Section 1, the expenditure of $57,000.00, or so much thereof as may be necessary, is hereby authorized in fund 7735 (Northland and Other Acquisitions), Project P440119-100000 (Public Art), Dept. 44-06 (Planning), in Object Class 06 (Capital Outlay) per the accounting codes in the attachment to this ordinance.

 

SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.

 

SECTION 6.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
