Explanation

 

1.0 BACKGROUND:  This legislation authorizes the Director of Public Utilities to execute a planned modification to the 2020 - 2022 Construction Administration/Inspection (CA/CI) Services agreement with DLZ Ohio, Inc.

 

Funding for this modification will be for the following projects:

 

•                     Division of Water, Olentangy River Road 24” Water Main - Phase 2 Project, CIP No. 690588-100001, Planning Area = 38 - Olentangy West, $524,469.13

 

•                     Division of Water, General Construction Projects, CIP No. 690549-100011, Planning Area = 99 - Citywide, $50,000.00

 

•                     Division of Power, Circuit 30 Street Lighting Improvements, CIP No. 670871-100000, Planning Area = 56 - Near East, $123,463.45

1.2. Reasons additional goods/services could not be foreseen:  

This is a three-year agreement for fiscal years 2020 - 2022 and modifications were anticipated and explained in the original legislation under Ordinance No. 0052-2020.

 

1.3. Reason other procurement processes are not used: 

This is a multiyear contract that will be modified as required to provide construction administration / inspection services for construction projects that bid during the three year (2020-2022) timeframe.   

 

1.4. How cost of modification was determined:

Cost proposals were provided by DLZ Ohio, Inc., reviewed by the Divisions of Water and Power and deemed acceptable.

 

2.0 ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:  The Department of Public Utilities does not have the manpower to perform all of the duties necessary to administer and inspect construction of said projects; DLZ Ohio, Inc. will perform the services.

 

The goal of the Olentangy River Road 24-Inch Water Main (Phase 2) project is to replace the existing 20-inch water main in Olentangy River Road which has broken multiple times.  Replacement of this water main will decrease the burden on water maintenance operations and improve customer service.  The Neighborhood Liaison(s) has been contacted and informed of this project.  Further community outreach may result through the Neighborhood Liaison Program.

 

The re-construction of the Circuit 30 Street Lighting Improvements project will result in an energy consumption savings for the City of Columbus.

 

3.0 FUTURE MODIFICATION(S):  The Department anticipates requesting additional future modifications to this contract as new construction projects begin during 2021 and 2022.

 

4.0 EMERGENCY DESIGNATION:   Emergency designation is not requested.

 

5.0 FISCAL IMPACT:  There are sufficient funds within the Electricity G.O. Bond Fund - Fund No. 6303.

 

A transfer of $524,469.13 will be necessary within the Water G.O. Bonds Fund - Fund No. 6006 as well as an amendment to the 2020 Capital Improvement Budget.

WHEREAS, Ordinance No. 0052-2020, passed February 10, 2020, authorized the original agreement for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, Ordinance No. 0851-2020, passed May 4, 2020, authorized Modification No. 1 for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, Ordinance No. 1459-2020, passed July 20, 2020, authorized Modification No. 2 for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, Ordinance No. 2652-2020, passed December 7, 2020, authorized Modification No. 3 for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, Ordinance No. 0030-2021, passed March 1, 2021, authorized Modification No. 4 for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, Ordinance No. 0574-2021, passed March 29, 2021, authorized Modification No. 5 for Construction Administration / Inspection Services for 2020 - 2022 for Department of Public Utilities capital improvements projects with DLZ Ohio, Inc.; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to execute a contract modification (No. 6) to the 2020 - 2022 Construction Administration/Inspection Services Agreement with DLZ Ohio, Inc., for the Division of Water’s Olentangy River Road 24” Water Main Phase 2 and CA/CI Services for Water's General Construction Projects, and for the Division of Power’s Circuit 30 Street Lighting Improvements Project; and

 

WHEREAS, it is necessary to authorize the expenditure of up to $123,463.45 from the Electricity G.O. Bond Fund - Fund No. 6303; and

 

WHEREAS, it is necessary to authorize a transfer and expenditure up to $574,469.13 within the Water G.O. Bonds Fund - Fund No. 6006; and

 

WHEREAS, it is necessary to authorize an amendment to the 2020 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditures; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, to authorize the Director of Public Utilities to enter into a modification of the construction administration/construction inspection services for the Division of Water’s Olentangy River Road 24” Water Main Phase 2 and CA/CI Services for Water's General Construction Projects, and for the Division of Power’s Circuit 30 Street Lighting Improvements Project, with DLZ Ohio, Inc., for the preservation of the public health, peace, property and safety; now therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized to modify and increase the 2020 - 2022 Construction Administration / Inspection Services Agreement with DLZ Ohio, Inc., 6121 Huntley Road, Columbus, Ohio 43229 (FID #31-1268980); in the amount of up to $697,932.58; in accordance with the terms and conditions of the contracts on file in the offices of the Divisions of Water and Power.

 

SECTION 2.  That the transfer of $524,469.13, or so much thereof as may be needed, is hereby authorized in Fund 6006 - Water G.O. Bonds Fund, in Object Class 06 - Capital Outlay, per the accounting codes in the attachment to this ordinance. 

 

SECTION 3. That the expenditure of up to $123,463.45 is authorized from the Electricity G.O. Bond Fund - Fund No. 6303, per the accounting codes in the attachment to this ordinance.

 

SECTION 4. That the expenditure of up to $574,469.13 is authorized from the Water G.O. Bond Fund - Fund No. 6006, per the accounting codes in the attachment to this ordinance.

 

SECTION 5. That the 2020 Capital Improvements Budget is hereby amended in Fund 6006 - Water G.O. Bonds Fund, per the funding template attachment to this ordinance.

 

SECTION 6.  That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 7.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 10. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
