Explanation

 

1. BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract agreement with Danbert Electrical Corporation for the Circuit 30 Street Lighting Improvements Upgrade project, CIP No. 670871-100000, in an amount up to $1,081,356.22 for the Division of Power.

 

This project will involve the complete re-construction of Street Lighting Circuit #30. The project will involve the separation of the overhead lighting and underground lighting into two (2) circuits, as they currently exist as one (current CKT #30). A new underground circuit will be the result. The project will also re-design the current HPS lighting with LED lighting.

 

The planning area for this project is "Near East" (Planning Area 56).

 

2. ECONOMIC IMPACT/ADVANTAGES; COMMUNITY OUTREACH; PROJECT DEVELOPMENT; ENVIRONMENTAL FACTORS/ADVANTAGES OF PROJECT:

The project will re-construct what is currently existing Street Lighting circuit #30.  The project will replace existing equipment, as well as separate overhead and underground lighting into (2) circuits.  This will improve the reliability of the lighting within the project area. All new lighting will be LED.  Existing HPS lighting will be converted to LED lighting. This will result in an energy consumption savings for the City of Columbus.

3.0 CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened four (4) bids on April 21, 2021: Danbert Electrical Corporation - $1,081,356.22; Complete General Construction - $1,186,911.22; U.S. Utility Contractor - $1,310,120.23; and Thayer Power and Communication - $1,845,204.05.

 

3.1 PRE-QUALIFICATION STATUS: Danbert Electrical Corporation has met code requirements with respect to pre-qualification, pursuant to relevant sections of Columbus City Code Chapter 329. 

 

Danbert Electrical Corporation’s bid was deemed the lowest, best, most responsive and responsible bid in the amount of $1,081,356.22.  Danbert Electrical Corporation’s Contract Compliance Number is 82-2707993 (expires 8/22/21, MAJ); DAX Vendor Account No. is 23222. 

 

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Danbert Electrical Corporation.

 

4. FISCAL IMPACT:  This legislation authorizes an expenditure of up to $1,081,356.22 from the Electricity Bond Fund 6303.  The legislation also authorizes and expenditure of up to $2,000.00 for prevailing wage services to the Department of Public Service.  There are sufficient funds within the Electricity G.O. Bonds Fund - Fund No. 6303.

5. TIMELINE: Contract work is required to be completed in a manner acceptable to the City within 180 days from the date that a Notice to Proceed (NTP) is given by the City.

6. EMERGENCY DESIGNATION: Emergency action is not requested at this time.

(General Obligation) Bonds Fund  for prevailing wage services to the Department of Public Service, and to authorize the expenditure of up to $1,081,356.22 from the 2020 Electricity G.O. (General Obligation) Bonds Fund. ($1,083,356.22)

 

Body

 

WHEREAS, four (4) bids for the Circuit 30 Street Lighting Improvements Upgrade project, were received and publicly opened in the offices of the Director of Public Utilities on April 21, 2021; and

 

WHEREAS, the lowest, best, most responsive and responsible bid was from Danbert Electrical Corporation in the amount of $1,081,356.22 per the Bid Tabulation and Quality Factor Form processes; and

 

WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract with Danbert Electrical Corporation and to encumber and expend funds to provide for payment of construction inspection and prevailing wage charges for the Division of Power’s Circuit 30 Street Lighting Improvements Upgrade project; and

 

WHEREAS, it is necessary to authorize the expenditure of up to $1,081,356.22 from the Electricity G.O. (General Obligation) Bonds Fund 6303; and

 

WHEREAS, it is necessary to authorize the expenditure of up to $2,000.00 for Prevailing Wage Services to the Department of Public Service; and

 

WHEREAS, it has become necessary in the usual daily operation of the Division of Power, Department of Public Utilities, to authorize the Director of Public Utilities to enter into an agreement for construction services with Danbert Electrical Corporation for the Circuit 30 Street Lighting Improvements Upgrade project, for the preservation of the public health, peace, property, and safety; and now, therefore

 

 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is authorized to execute a contract for the Circuit 30 Street Lighting Improvements Upgrade project with Danbert Electrical Corporation, 7991 Memorial Dr., Plain City, Ohio 43064; in an amount up to $1,081,356.22; in accordance with the terms and conditions of the contract on file in the Office of the Division of Power.

 

SECTION 2.  That the expenditure of up to $1,083,356.22, inclusive of $2,000.00 for prevailing wage services to the Department of Public Service, or so much thereof as may be needed, is hereby authorized per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the said contractor shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power.

 

SECTION 4. That the funds necessary to carry out the purpose of this Ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 6. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 8.  That this ordinance shall take effect and be in force from and after the earliest date allowed by law.
